Basın iş kanunu kapsamındaki gazetecilerin iş güvencesi hükümlerinden yararlanma koşulları

Özet

Çalışmanın konusu, 9.8.2002 tarihinde 4773 sayılı Kanun ile hukuk sistemimize girmiş olan ve 4857 sayılı İş Kanunu’nda da kabul edilmiş bulunan iş güvencesi kuru- munun, m.116’nın yapmış olduğu atıf nedeniyle, 1952 tarih ve 5953 sayılı Basın İş Kanunu’na tabi işçiler açısından uygulanmasıdır. İş güvencesi kurumunun hangi işçiler açısından uygulanacağının tespit edilmesi noktasında, Basın İş Kanunu’na hangi işçile- rin tabi olduğu tespit edilecektir. Buradan hareketle gazetecilik vasfına kimlerin sahip olduğu ve gazetecilik vasfına sahip olan kişilerden kimlerin Basın İş Kanunu kapsamına dâhil olduğu belirlenecektir.

Abstract

The subject of this study is the appliance of job security system which was entered in our judicial system on date 9.8.2002 with Code No. 4773 and which was accepted in Labor Law with Code No. 4857, by the reason of reference of Art. 116; in terms of employees who are subject to Press Labor Code on date 1952 with Law No. 5953. It will be identified by the scope of the law; on which employees are in appliance scope, in terms of employees who are subject to Press Labor Law. Hence, it will be identified that; who has the journalism qualification and among these, who will be included in scope of Press Labor Law.
