İslam hukukunda iddet, evliliğin herhangi bir sebeple sona ermesidurumunda nikâh hükümlerinin tamamen ortadan kalkması ve ka- dının yeni bir evlilik yapabilmesi için beklemesi gereken süreyi ifa- de eder.İddet, kendisine sebebiyet veren olaya göre boşanma veya ölümiddeti olarak ikiye ayrılarak incelendiği gibi iddet süresine görehayız, hamilelik ve süreli iddet şeklinde de ayırıma tabi tutulabilir.Racʽî talaktan dolayı iddet bekleyen kadına açık veya gizli evlilikteklifi, bâin talaktan dolayı iddet bekleyen kadına ise açık evlilikteklifinin yapılamayacağında ittifak söz konusudur. Yine vefat id- detini bekleyen bir kadına, açık evlilik teklifi yapılamazken üstükapalı evlilik teklifi yapılabileceğinde ittifak edilmiştir.Yasak olmasına rağmen iddet halinde yapılmış olan evliliğin, farkedildiği anda iptal edilmesi ve tarafların tefrik edilmesinde İslamhukukçuları arasında ittifak, tefrik edilen tarafların iddet bittiktensonra yeniden evlenip evlenemeyeceklerinde ise ihtilaf söz konu- sudur.

Abstract

In the Islamic Law, Iddet means the disappearence of the marria- ge principles with the ending of the marriage because of any reasons and the time must be waited for another marrige by thewoman.Iddet can be classified in two with regard of the causes of the ac- tion giving rise the divorce as the iddet of divorce and death, andit also can be subjected to a classification for the time of iddet asmenstruation, pregnance and periodical iddet.As it is impossible to make a marriage proposal to a woman whois waiting the time of iddet directly or indirectly, there is an agre- ement on the subject of the impossibility of making a marriageproposal to a woman directly. As it is not possible to make a mar- riage proposal to a woman waiting iddet of death directly, an indi- rect proposal is possible only with an agreement.There is an agreement among the Islamic Lawyers on the subjectof canceling the marriage which has taken place notwithstandingthe ban, but the agreement isn't available about the marrige ofthe same couple after the time of iddet.
