Özet

GAZEL, Ahmet Ali, Osmanlı Devleti’nde Parlamento Fesihleri (1877- 1920), CTAD, Yıl 18, Sayı 35 (Bahar 2022), s. 67-101. 23 Aralık 1876 tarihinde Kanun-ı Esasi’nin ilanıyla Osmanlı Devleti’nde mutlak monarşiden meşrutî monarşiye geçilmiş ve bu değişimin sonucu olarak da parlamento açılmıştır. Osmanlı Devleti’nde parlamento, Birinci Meşrutiyet Devrinde iki, İkinci Meşrutiyet Devrinde dört olmak üzere altı yasama dönemi olarak faaliyette bulunmuştur. Birinci Meşrutiyet Dönemi’nde toplanan ilk Meclis üç ay sonra dağılmış, İkinci Meclis ise II. Abdülhamit tarafından tatil edilmiştir. Ancak bu tatil 30 yıl sürmüştür. Yeni Meclis ancak İkinci Meşrutiyet’in ilanı sonrası 1908 yılında açılabilmiştir. İkinci Meşrutiyet Dönemi’nde dört meclis yasama faaliyetinde bulunmuştur. Ancak bu dört meclis de süresini tamamlayamadan feshedilmiştir. Osmanlı Devleti Dönemi’nde fesih hakkı parlamenter sistemin özüne ve değerlerine uygun işletilememiştir. Bu durum Cumhuriyet Dönemi anayasa yapıcıları üzerinde olumsuz bir etki bırakmıştır. Cumhuriyet Dönemi’nde anayasa yapıcıları bu kuruma yer vermemiş ya da gerçekleştirilmesini oldukça zorlaştırmıştır. Bu makalede Osmanlı Devleti’ndeki parlamento fesihleri anlatılmıştır. Makale hazırlanırken Meclis-i Mebusan ve Ayan Zabıt Ceridelerine ve dönemin basınına başvurulmuştur. Bunun yanında bu konuda yazılmış araştırma eserlere de bakılmıştır.

Abstract

GAZEL, Ahmet Ali, Parliament Dissolutions in the Ottoman State (1877- 1920), CTAD, Year 18, Issue 35 (Spring 2022), pp. 67-101. With the proclamation of the Ottoman Basic Law (“Kanun-ı Esasi”) on December 23, 1876, the Ottoman Empire passed from absolute monarchy to constitutional monarchy. As a result of this change, the parliament was opened. In the Ottoman State, the parliament operated for six legislative periods, two in the First Constitutional Period and four in the Second Constitutional Period. The first parliament convened in the First Constitutional Period was dissolved three months later. The second parliament was suspended by Abdulhamid II. However, this suspension lasted 30 years. The new parliament could only be opened in 1908 after the proclamation of the Second Constitutional Monarchy. During the Second Constitutional Period, four parliaments were involved in legislative activities. However, these four parliaments were dissolved before they could complete their term. During the Ottoman period, the right of dissolution could not be executed in accordance with the essence and values of the parliamentary system. This situation had a negative effect on the constitution makers of the Republican period. In the Republican period, the constitution makers did not include this institution or made it very difficult to do. In this article, the parliamentary dissolutions in the Ottoman Empire are explained. While preparing the article, it was referred to the minutes of the Chamber of Deputies and the Assembly of Notables and to the press of the period. In addition, research works written on this subject were also examined.
