İslâm Ceza Hukukunda Hâkimin Şahide Şahitliği ile İlgili Telkinde Bulunması

Özet
Mahkemede bir olaya tanıklık eden şahit gerek hüküm verilmeden önce gerek hüküm verilip infaz edilmeden önce kendiliğinden şahitliğinden dönebileceği gibi hâkimin bu yönde telkinde bulunması sonucu da şahitliğinden dönebilir. Her iki durumda da şahitlik sanki hiç yapılmamış gibi geçersiz olur ve hâkim şahidin önceki beyanına dayanarak hüküm tesis edemez. Çünkü şahidin önceki beyanı ile sonraki beyanı çelişmiş olur. Çelişkili beyana dayanarak hâkimin hüküm vermesi ise İslâm’ın adalet prensibi ile bağdaşmaz. Zira şahidin şahitliğinden dönmesi suçun sübutunda şüphe oluşturur. Şüphe ise sanık lehine yorumlanarak cezalar düşürülür. Bu sebeple İslâm hukuk doktrininde hâkimin mahkeme esnasında şahide şahitliği ile ilgili herhangi bir telkinde bulunup bulunmayacağı konusu etraflıca ele alınmıştır. İslâm hukukçuları Allah hakları ağır basan had cezası davalarında hâkimin şahide şahitliğinden vazgeçmesini ya da şahitliğinden dönmesini telkin edip edemeyeceği konusunda ihtilafa düşmüşlerdir. İslâm hukukçularının büyük çoğunluğu hâkimin Allah hakkı kapsamına giren had cezası davalarında şahide telkinde bulunmasını caiz görürken bazı hukukçular bunun caiz olmadığını ileri sürmüşlerdir. Konusu kısas, iffete iftira (kazif) ve mal olan kul hakları ile ilgili davalarda ise İslâm hukukçularının cumhuru hâkimin şahide hiçbir şekilde telkinde bulunmasının caiz olmadığı görüşünü benimsemişlerdir. Bazı hukukçular ise mahkemenin azametinden çekinen şahitlerin meramını düzgün şekilde anlatabilmesi için bunun da caiz olduğunu söylemişlerdir. Bu çalışmada hâkimin şahide şahitliği ile ilgili herhangi bir telkinde bulunmasının caiz olup olmadığı ile ilgili görüşleri ele aldık.
Abstract
A witness who witnessed an event in the court may return from his witness spontaneously, either before the verdict is given or before the verdict is executed, or may also return from the witness as a result of the judge’s suggestion in this direction. In both cases, the witnes becomes invalid as if it had never been done and the judge cannot make a judgment on the basis of the witness’s previous statement. Because the witness’s previous statement and his next statement would be in conflict. Judge’s decision based on contradictory declaration is incompatible with the justice principle of Islam. Because the witness’s return from his witness creates suspicion in the origin of the crime. Suspicion is interpreted in favor of the defendant and penalties are reduced. For this reason, in the Islamic legal doctrine, the issue has been discussed in detail whether the judge will make any suggestions about witnessing during the trial. Islamic jurists disagreed on whether the judge could suggest that he should give up his witness or to renounce his witness in cases of the hadd penalty whose rights are overwhelming by Allah. While the majority of Islamic jurists consider it permissible for the judge to suggest witness in cases of the hudud punishment that fall within the scope of the right of Allah, some jurists argue that this is not permissible. In cases related to retaliation, slander of chastity (Qazf) and property rights, the majority of Islamic jurists adopted the view that it is not permissible for the judge to suggest witness in any way. Some lawyers said that it was also permissible so that witnesses who were afraid of the court’s grandeur could express their intention properly. In this study, we discussed the opinions about whether it is permissible for the judge to make any suggestions about witnessing.
