Özet
6769 sayılı Sınai Mülkiyet Kanunu ile markaların iptali için idari iptal prosedürü öngörülmüştür. Marka Hukuku bakımından daha önce var olmayan bu idari prosedür, Sınai Mülkiyet Kanunu’nun 26’ncı maddesinde “iptal halleri ve iptal talebi” başlığı altında düzenlenmiştir. Çalışmamız kapsamında markanın iptali talebinin sunulacağı makam, talepte bulunabilecek kişiler, talebin süresi, iptal talebinin sonuçları ve etkisi üzerinde durulacaktır. Markaların iptali ile ilgili olarak Sınai Mülkiyet Kanunu’nun yürürlüğe girmesinden birkaç gün önce Anayasa Mahkemesinin mülga 556 sayılı KHK’nın 14’üncü maddesini iptal etmesi nedeniyle Sınai Mülkiyet Kanunu’nun 26’ncı maddesinin uygulanmaya başlayacağı zamana ilişkin çeşitli sorunlar öğretide tartışılmaktadır. Tartışmalı olan bu husus başkaca çalışmalara konu olmuştur. Bunlar da dikkate alındığında prosedürün işleyişi üzerinde durulması yönünde bir tercih yapılmıştır. Çalışmada idari iptal prosedürünün işletilmesi üzerinde durulacağından iptal hallerinin detaylarına da girilmeyecektir.
Abstract
The Industrial Property Law No. 6769 sets forth the administrative cancellation procedure for the cancellation of trademarks. This administrative procedure, which had not existed before in terms of Trademark Law, was regulated under the heading “cancellation and cancellation request” in Article 26 of the Industrial Property Law. Within the scope of our work, it will be focused on the position which the request of the cancellation of trademark would be submitted, the people who has a right of request of cancellation, the results and effects of the cancellation. Many issues related to when the Article 26 of the Industrial Property Law will start to be implemented are discussed in the doctrine just few days Constitutional Court’s annulment of the Article 14 of the Decree Law No. 556. This controversial point has been the subject of further work. It is prefered to focus on the operation of the procedure by taking consideration the other works. The details of the cancellation process will not be discussed in the article because the operation of the administrative cancellation procedure will be focused on.
