1980 Tarihli Uluslararası Çocuk Kaçırmanın Hukuki Veçhelerine Dair La Haye Sözleşmesi’ne Göre Çocuğun İadesinin Reddi Sebepleri

Özet
Uluslararası unsurlu evlilikler ayrılıkla sonuçlandığında, diğer ebeveyni cezalandırmak amacıyla çocuğun mutad meskeninden başka bir üye devlete götürülmesi veya diğer ebeveynin rızası dâhilinde götürüldüğü ülkede alıkonması durumlarında 1980 tarihli Uluslararası Çocuk Kaçırmanın Hukuki Veçhelerine Dair La Haye Sözleşmesi gündeme gelecektir. Bu sözleşmenin amacı, hukuka aykırı olarak yeri değiştirilen çocuğun bir an evvel, önceki mutad meskeninin bulunduğu akit devlete iadesini ve taraf bir devletteki koruma ile ziyaret haklarına, diğer taraf devletlerde etkili bir biçimde riayet edilmesini sağlamaktır. Bu sözleşme adli işbirliğine ilişkindir ve Sözleşme’ye göre kural olarak çocuk, mutad meskenine derhâl iade edilmelidir. Ancak, istisnai olmakla birlikte iadenin reddi de mümkündür. İadenin reddi sebepleri Sözleşme’nin 12, 13 ve 20’nci maddelerinde düzenlenmiştir. Çalışmamızda örnek kararlar ışığında iadenin reddi sebepleri ele alınmış olup, Sözleşme’nin 13/1 b hükmü ayrı bir çalışma konusu teşkil edeceğinden çalışmamız kapsamına alınmamıştır.
Abstract
When the marriages with international element result in separation, the Hague Convention on the Legal Aspects of International Child Abduction in 1980 will be raised in cases where the child is taken away from his/her habitual residence to another member state in order to punish the other parent, or if the other parent is detained in his/her country of origin. The purposes of this Convention are to secure the return of the child who has been displaced wrongfully to the Contracting State as soon as possible and to ensure the rights of custody and of access under the law of one Contracting State are effectively respected in the other Contracting States. This contract relates to judicial cooperation and, as a rule, the child should be returned immediately to the habitual residence. However, it is possible to refuse the return, although it is exceptional. The reasons for the refusal of return are set out in the articles 12, 13 and 20 of the Convention. In our study, the reasons of refusal of return are discussed in the light of sample judicial decisions and the provision of 13/1 b is not included in our study since it will be a separate study topic.
