Özet

Toplumun temel taşı ailedir. Sağlam bir aile sağlam bir toplum demektir. Kur’an ve sünnet aileye büyük önem vermiştir. Aile kurmak gerek şekilsel gerekse maddi olarak oldukça kolaylaştırılmıştır. Hz. Peygamber’in tavsiyeleri ve kızı Fâtıma için hazırlamış olduğu mütevazı çeyiz bunun delilidir. Kızın veya kız tarafının koca evine ve akrabalarına getirdiği her türlü mal ve hediyeler çeyiz olarak adlandırılır. İslâm aile hukukunda çeyiz etrafındaki tartışmalar iki noktada yoğunlaşmaktadır. Bunlardan ilki kadının çeyiz hazırlamak zorunda olup olmadığıdır. Çoğunluğa göre,kadınlar çeyiz hazırlamak zorunda değildir. Bunlara göre,eşlerin birlikte yaşayacakları evin tüm hazırlıklarının nafaka mükellefi koca tarafından yapılması gerekir. Mâlikîler ise kadını, aldığı mehre uygun düşecek şekilde çeyiz hazırlamakla sorumlu tutmaktadırlar. İkinci ihtilaf noktası ise evliliğin sona ermesinden sonra çeyiz eşyalarının paylaşımında nasıl bir yol takip edileceğidir. Genel olarak erkeğin kullandığı eşyaların erkeğe, kadının kullandığı eşyaların kadına verileceği kabul edilmektedir. Ancak her iki eşe ait olma ihtimali bulunan eşyaların paylaşımında ittifak edilen belli bir yöntem olmayıp daha çok örf esas alınmaktadır.

Abstract

Family is the cornerstone of society. A solid family means a solid society. The Qur’an and the Sunnah gave great importance to the family. Family building has beenfacilitated both formally and financially. The Prophet’s advice and the modest dowry he prepared fot his daughter Fâtima are proof of this.All kinds of goods and gifts brought by the brideor thebride’sside to the husband’s house and relatives are called dowry. The debate) around dowry in Islamic family law focuses on two points. One of these is whether the woman has to prepare a dowry or not. According to the majorityof the fuqaha, women do not have to prepare dowry. According to them, all preparations of home, in which the spouses will live together, must be done by the husband who is responsible for maintenance. Malikîs hold the woman responsible for preparing the dowry, so that themunicipality they receive is appropriate. The second point of disagreement is how to follow the way in which dowries are shared after the end of marriage. It is generally accepted that the goods used by the man will be given to man and the goods used by the woman will be given to the woman. However, it is not a certain alliance in the sharing of goods that are likely to belong to both spouses, but rather it is based on custom.
