EMRİN UMÛMİLİĞİ HUSUSUNDA MEZHEBİNE MUHALİF BİR FAKİH EBU’L-YÜSR EL-PEZDEVÎ

Özet

Fıkıh usûlü ilminde lafızlar bahsinin önemli bir kısmını teşkil eden emir, fakihlerce detaylı incelemelere tabi tutulmuştur. Emrin tekrar diğer bir deyişle umûm ifade edip etmediğifıkıh usûlü ilminin araştırma konularından birisi olmuştur. Hanefî usûlcülerinin ekseriyeti bu türden bir lafzın tekrar ifade etmeyeceğini ve tekrara da ihtimali olmadığını savunmuşlardır. Bu nedenle her gün edâ edilen beş vakit namaz gibi tekrarı gerektiren emirleri sebeplerle ilişkilendirmişlerdir. Şâfiî, Mâlikî ve Hanbelî fakihleri birtakım şartların sağlanması halinde emrin umûmîliğini yani tekrar ifade edebileceğini benimsemişlerdir. Hanefî mezhebine mensup olan Ebü’l-Yüsr el-Pezdevî ise mezhep içerisinde tercih edilen görüşe muhalefet ederek emrin bir delil veya karîne vasıtasıyla umûm ifade edebileceğini dile getirmiştir. Bu çalışmada Ebü’l-Yüsr ile Hanefî usûlcülerinin emrin tekrarı hususundaki düşüncüleri mukayese edilerek her iki görüş detaylı bir şekilde irdelenmiştir. Yapılan incelemenin sonucunda mezhep içerisindeki bu ihtilafın emirle talep edilen herhangi bir fiilin yeniden farzolmasının mecâzen sebeplere izâfe edilip edilemeyeceği sorusuna verilen cevapla ilişkili olduğu tespit edilmiştir.

Abstract

The command, which constitutes an important part of utterance subject in usul al-fıkh, was subjected to detailed examinations by scholars. Whether the commands express the generality repetition, in other words, has been one of the research subjects of the science of usul al-fıkh. Most of the Hanafi fuqahas have argued that this type of utterance does not mean repetition and impossible repeat too. For this reason, they associated the commands that require repetition, such as the five time prayer in every, for causes. Other schools have adopted the generality of the command if the necessary conditions are met. Abu Yusr al-Bazdawi,who is a member of the Hanafi school, is of the opinion that, unlike his school, the command can be generalized with the help of proof or presumption. In this study, Abu Yusr and Hanafi scholar’s thoughts on repetition of the command were compared and both views were examined in detail. As a result of the examination, it was determined that this dispute within the school was about howto require explanation of the repetition which was demanded action by the command.
