Sağlık Hizmetlerinde İdarenin ve Hekimlerin Sorumluluğu

Özet

Bu çalışmada sağlık kamu hizmetleri kapsamında idarenin ve hekimin sorumluluğu ele alınmıştır. Bu bağlamda öncelikle sağlık, sağlık hakkı ve sağlık kamu hizmeti, sonrasında ise idarenin kusura dayanan sorumluluğu ve kusursuz sorumluluğuna değinilmiştir. Hekimin idareye karşı sorumluluğu ve bu kapsamda rücu konusu ile son olarak uyuşmazlıklarda hangi yargı organlarının görevli olduğu konusu anlatılmıştır

Abstract

In this study, the administrative responsibility and the doctor’s responsibility are dealt with within the framework of the health public services. In this context, Ş rstly, health, a right of health and the health public service are addressed. Following this introductory part, the administration’s defect liability and absolute liability are examined. Then doctors’ responsibility to the administration is examined and, in this context, recourse to administration is also expressed. The paper ends with an analysis of the determination of court jurisdiction when the disputes arise
