İdarenin sorumluluğunu ortadan kaldıran nedenlerden biri olmakla birlikte, mücbir sebep günümüz teknolojisi ve bilimsel gelişmeler karşısında artık bu özelliğini kaybetmektedir. İdarenin gerek mücbir sebep teşkil eden hadise öncesi yapması gereken denetimi yapmaması ve gerekse olay vuku bulduktan sonra alması gereken önlemleri almakta geçikmesi veya hiç almaması hizmet kusurunu oluşturur

In spite of being one of the reasons that remove the liability of administration, force majeure has started to lose this feature in view of today’s technology and scientifi c development. Controls that an administration should do before the incident that cause force majeure as well as delay or failure in taking measures after such an incident form the fault of service
