Özet
Açlık grevleri iki yönden incelenmiştir. Ancak bu iki yönün iç içe geçtiğini söylemek olmaz. İlki, tıbbi etik diğeri tüzel yön. Ancak bu iki açıdan incelenmesine geçmeden, açlık grevlerinin tarihçesi kısaca anlatılmıştır. Tıbbi etik açısından açlık grevleri uluslararası ve ulusal belge ve bildirgeler çerçevesinde ele alınmıştır. İki temel uluslararası bildirge, Tokyo ve Malta Bildirgeleridir. Türkiye'deki mevzuat, bu metinler ışığında değerlendirilmiştir. Tıbbi etik tartışmalarına yer verilen ilk bölümde, açlık grevcilerine ve ölüm orucundakilere nasıl yaklaşılacağı, müdahalenin olanaklılığı, hekim-hasta ve hekim-grevci ilişkileri bağlamında değerlendirilmiştir. Tüzel incelemenin yapıldığı ikinci kısımda, kamu tüzesi ve özel tüzede konuyla ilgili bir düzenleme olup olmadığı araştırılmış, ardından, anayasal çerçevede ele alınan açlık grevlerinin, yaşam hakkı ve düşünceyi açıklama ve yayma hakkı bağlamında incelenebileceği sonucuna varılmşıtır.
Abstract
Hunger strikes should be examined from two sides-both can be either right, or wrong, or one or the other can be mistaken, depending on the way you look at things. The first side is medical ethics. The second side is legal ethics. We have studied the history of hunger-strikes, both in Turkey, and the world. In the first part of the article, hunger strikes (among political prisoners and others), refusing consent to treatment and solution of force-feeding have been examined in the frame of international medical declarations (like Tokyo and Malta) and national lawbs. As a consequence, some results have been reached. All these declarations give importance to, and stres on these two words: PEOPLES WILL. The Hippocrates oath, rules and principles of religions, moral rules of society must be evaluated together with the will of the people. The second part of the article examines if there is any provision relating the concept of hunger strikes in Turkish national law, to the Turkish constitution. After that, huger strikes have been examined in the frame of fundamental rights, especially, the right to live and freedom of thought. Article 26 of the Constitution of the Turkish Republic is about freedom of expression and dissemination of thought which would be seen related to hunger strikes. This article says, "Everyone has the right to Express and disseminate their thought and opinion by speech, in writing or in pictures or through other media, individually or collectivelly�" My opinion is, hunger strikes (which are not suicide or euthanasia) would be thought as a way of expressing ideas "through other media".
