Özet
1990'lardan itibaren Irak'ta yaşanan gelişmeler sonucunda Kürtler Irak'ın kuzeyinde bir devlet kurma konusunda tarihsel bir fırsat yakaladılar. Bu yüzden Kuzey Irak'ta mümkün olduğunca güçlü bir egemenlik elde etmek için çabalamaktadırlar. Bu gelişmeler sonucu eğer burada bağımsız bir devlet kurulursa, bu devlet meşruluğunu self-determinasyon ilkesinden almalıdır. Çünkü 20. Yüzyıl boyunca kurulan devletler hep-bu ilkeyi temel almışlardır. Zaten Kürtler de bu ilkeye dayandıklarını söylemektedirler. Fakat bu ilke farklı zamanlarda farklı anlamlar taşımıştır. Özellikle BM döneminde kurulan devletlerin çoğunun bağımsızlığı sömürgelikten ve yabancı işgalinden kurtulma anlamına gelen dış self-determinasyona dayandırılmıştır. Bununla birlikte, kavram son zamanlarda daha geniş yorumlanarak etnik azınlıklar için ayrılma hakkı anlamında kullanılmaya başlanmıştır. Uluslararası topluluk etnik azınlıkların self-determinasyonunu açıkça benimsemese de, iç self-determinasyonun gerçekleştirilememesi halinde ayrılma hakkını bir istisna olarak tanımaktadır.
Abstract
After the developments occurred in Iraq during 1990s, the Kurds gathered a historical opportunity to establish a state in Northern Iraq. Therefore, they have been trying to obtain a strong sovereignty in the region. If a separated state is founded in this region, its legitimacy must rely on the self-determination principle. Because, this principle has been the basis for the states established during the 20lh Century. The Kurds of Iraq also have been relying on this principle. However, the concept of self-determination has been used in different meanings in different times. Especially, the independence of most of the established states in the time of the UN were generally relied on external self-determination that means decolonisation or liberation from foreign occupation hırt no separation right. Besides, recently this concept has been interpreted more comprehensively and used to mean a separation right for ethnic minorities under some specific conditions. The international community has not clearly adopted the self-determination right of ethnic minorities, but exceptionally recognizes the-separation right if internal self-determination cannot be realized. This paper investigates the legitimacy of a probable separation in Northern Iraq in terms of the interpretations and practices of self-determination and claims that creation of a new state in the region could have legitimate grounds but would also cause major difficulties.
