Boşanmanın Eşler Açısından Genel Sonuçları Bağlamında Yoksulluk Nafakasına İlişkin Değerlendirme

Özet
Türk Medeni Kanunu’nun aile hukuku kitabının birinci kısmında boşanmaya müstakil bir bölüm ayrılmıştır. Boşanma; evlilik birliğine geçmişe etkisi olmayacak şekilde hâkim hükmü ile son verilmesidir. Boşanmanın gerçekleşebilmesi için eşlerin sağ iken karşılıklı veya tek taraflı olarak dava açması gerekir. Boşanmayla kişiler bazı haklar elde edebileceği gibi aynı zamanda bazı sorumluluklar da üstlenir. Kamuoyunda sıklıkla tartışılan yoksulluk nafakası bu hak ve yükümlülüklerden yalnızca biridir. Yoksulluk nafakası; boşanma sebebiyle yoksulluğa düşen eşe ödenen nafakadır. Diğer bir ifadeyle, yoksulluk nafakası eşlerden biri için hak iken diğeri için bir sorumluluğun yerine getirilmesidir. Günlük sosyal hayatın temelini teşkil eden aile kurumunun zor şartlarda birbirine destek olması amacıyla, aileyi meydana getiren fertler arasında nafaka kurumuna ihtiyaç duyulmuştur. Yoksulluk nafakası, her ne kadar aile birliği boşanma ile son bulsa da güzel günlerin ve yaşanmışlıkların hatırına boşanma sonucunda ihtiyaç sahibi eşi korumak için düzenlenmiştir. İyi niyetlerle yapılan bu düzenlemenin uygulamasında özellikle nafakanın ödeme süresine yönelik günümüzde birtakım tartışmalar yaşanmaktadır. Boşanmaların altında yatan temel problemlerin ve boşanma sonrası yaşanan diğer mağduriyetlerin birlikte incelenerek toplu bir şekilde kanuni düzenlemelerin gözden geçirilmesi gerekirken sadece yoksulluk nafakasının ödenme süresine ilişkin düzenlemede kısmi değişikliklere gidilmesi oldukça düşündürücüdür. Bu çalışma boşanan eşlerin hak ve sorumluluklarının yalnızca yoksulluk nafakasından ibaret olmadığını hatırlatmak ve yoksulluk nafakası tartışmalarına katkıda bulunmak amacıyla hazırlanmıştır.
Abstract
A section devoted to divorce is reserved in the first part of the Turkish Civil Code family law book. Divorce is the termination of the marriage union with the judge's judgment, without any influence on the past. In order for the divorce to take place, the spouses must file a lawsuit, mutually or unilaterally while they alive. With divorce individuals may have some rights at the same time they assume some responsibilities. Poverty alimony, which is frequently discussed in the public, is just one of these rights and obligations.Poverty alimony is the alimony paid to the spouse who fall into poverty due to divorce. In other words, poverty alimony is the right for one spouse, while the responsibility is fulfilled for the other. In order to secure the family institution, which forms the basis of daily social life, in terms of solidarity, alimony institutions were needed among the members of the family. Poverty alimony is designed to protect the needy spouse as a result of the divorce, for the sake of the good days and experiences, although the family union ends with divorce. In the implementation of this regulation made with good intentions, there are some discussions about the payment period of alimony. Although it is necessary to review the legal regulations collectively by examining the basic problems underlying divorces and other grievances experienced after the divorce, it is quite thoughtprovoking to make partial changes only in the regulation on the payment period of poverty alimony. This study was prepared in order to remind that the rights and responsibilities of divorced spouses do not only consist of poverty alimony and to contribute to the discussions on poverty alimony.
