Özet
Teknolojinin hızla geliştiği bir çağda, hukuk sistemlerinin buna kayıtsız kalması ve teknolojinin imkânlarından yararlanılmaması düşünülemez. developments Bu gelişmelere paralel olarak, görüntülü ve sesli iletişim teknikleri kullanılarak, ilgililerin duruşmaya (video konferans yöntemiyle) uzaktan katılımları sağlanmaktadır. Bu yöntemin kullanılması hukuk sistemlerine, transfer masraflarından tasarruf etme ve yargılamayı makul sürede tamamlama gibi birçok avantaj sağlamaktadır. Bununla beraber anılan yöntem, adil yargılanma hakkı kapsamındaki birçok güvenceyi sınırlamaktadır. Çalışmada, terminolojik bir tartışmanın ardından adil yargılanma hakkı ile ilgili genel esaslar açıklanmıştır. Devamında, medeni hak ve yükümlükler ile suç isnadına ilişkin uyuşmazlıklarda video konferans yönteminin kullanılması, Avrupa İnsan Hakları Mahkemesi ve Anayasa Mahkemesi içtihatları açısından değerlendirilmiştir. Çalışmanın sonunda ise mevzuat ile Yargıtay ve bölge adliye mahkemelerinin içtihadı ortaya konularak, duruşmaya uzaktan katılan her bir süje bakımından değerlendirmeler yapılmıştır.
Abstract
In an era where technology is developing so rapidly, it is unthinkable for justice systems to remain indifferent to this situation and not to benefit from the means of technology. In parallel with these developments, by using video and audio communication techniques (by video conference system), related persons can participate to the hearing remotely. Use of this system, provides many advantages to the justice systems such as saving transfer costs and completing the trial in a reasonable time. However, the aforementioned method limits many guarantees which are provided by the right to a fair trial. In the study, after a terminological debate, the general principles regarding the right to a fair trial is explained. Then, the use of video conferencing system in the determination of civil rights and obligations or criminal charge are evaluated in terms of the case law of the European Court of Human Rights and the Turkish Constitutional Court. At the end of the study, evaluations are made in terms of each party attending the hearing remotely, by putting forward the legislation and the jurisprudence of the Court of Cassation and regional courts of appeal.
