Özet
Türkiye ve Birlik arasındaki ortaklık hukuku, Adalet Divanı kararlari sayesinde belirli Türk vatandaşları için bir hak kaynağı olmuştur. Bu hususta yakin geçmişteki yıllar, Divanın içtihat hukukunda Katma Protokol md. 41(1) 'in yerleşme ve hizmet sunumu serbestisine ilişkin standstill hükmünün artan önemine tanıklık etmiştir. Belirli Türk vatandaşlarının Almanya 'ya vize olmaksızın seyahat etmesinin yolunu açan Soysal davası, bu alandaki çarpıcı örneklerden bir tanesidir. Böylelikle özel olarak söz konusu maddenin tam sınırlarının ve genel olarak ortaklık hukukundaki yerleşme ve hizmet sunumu serbestisinin kapsam ve etkilerinin incelenmesi ihtiyacı doğmuştur. Bundan dolayı bu makale, Birlik hukukundaki yerleşme ve hizmet sunumu serbestisi ile karşılaştırmak yoluyla, mevzubahis serbestilerin ortaklık hukukundaki kapsam ve etkilerini incelemeyi amaçlamaktadır.
Abstract
The association law between Turkey and the Union has been source of rights for certain Turkish nationals, thanks to the decisions of the European Court ofJustice. In this respect, the recent years have witnessed the increasing importance ofArticle 41(1) ofthe Additional Protocol the standstill provision concerning the freedom of establishment and to provide services in the case law of the Court. One striking example is the Soysal case which paved the way for certain Turkish nationals to travel to Germany without visa. Thus, need has emerged to explore the exact boundaries of this article in particular, and the scope and eflects of the fieedoms ofestablishment and to provide services in association law in general. Accordingly, this paper is an effort to examine the scope and eflects of the said freedoms in association law by comparing them with the same freedoms in European Union law.
