Özet

Ceza infaz kurumları; mahkemelerce verilen tutuklama tedbir kararlarınınveya hapis cezalarının infaz edildiği kurumlar olarak tanımlanabilir. Bu kurumlar ileilgili başta penoloji, kriminoloji, sosyoloji ve psikoloji olmak üzere birçok bilim dalı çalışma yapmaktadır. Bu çalışmalar arasında özel sektör tarafından yönetilen cezainfaz kurumlarının ayrı bir önemi bulunmaktadır. Tarihte ilk özelleştirilmiş hapishaneuygulaması Kral II. Henry Döneminde 1166 yılında İngiltere’de her şehirde “Goal”adı verilen tesislerin kurulması ile ortaya çıkmıştır. Daha sona bu uygulamanın;Bridewells adı verilen hapishaneler, borçluların barındırıldığı hapishaneler ve başkabir yere hükümlü nakli şeklinde devam etmiştir. 1960’lı yıllarda; Dünya’da suç veceza politikalarının değişmesi ayrıca işlenen suç sayısının artması ile bir yandanceza infaz kurumlarında bulunan hükümlü ve tutuklu sayısı yükselmiş, diğer yandanceza infaz kurumlarının yapım ve işletim maliyetleri artmıştır. Bu sorunun çözümüamacıyla; özel sektör tarafından ceza infaz kurumlarının inşa edilerek yönetilmesiveya bu kurumlardaki yemek ve hükümlü nakli gibi bir takım hizmetlerin özel sektörtarafından verilmesi modeli geliştirilmiştir. Bu Modelin ilk örneği Amerika BirleşikDevletleri’nde uygulamaya geçtikten sonra Avustralya ve İngiltere başta olmak üzerebirçok ülkede ceza infaz kurumları özel sektör tarafından yönetilmeye başlamıştır. Bumodelin uygulanma şekli ülkeden ülkeye farklılık göstermiştir.

Abstract

Penal institutions could be defined as the institutions where the ones aboutwhom the courts rule detention order or imprisonment sentence serve these imposedorders and sentences. Various fields, especially penology, criminology, sociology and psychology conduct studies on these institutions. The penal institutions managed bythe private sector have a special place among these studies. The first privatized prisonexample of the history emerged upon the establishment of the institutions named“Goal” in every city across the England in 1166 during the reign of the King HenryII. Then, this practice was continued also through the prisons named Bridewells, theprisons where the debtors were kept, and in the form of transfer of the convicts toanother place. In the 1960s, as a result of the change in the crime and punishmentpolicies around the world, on the one hand the number of the convicts and detaineesin the penal institutions increased, on the other hand, the construction and operatingcosts of the penal institutions increased. For the solution of this problem, the model wasdeveloped for managing the penal institutions by the private sector or provision by theprivate sector of some services such as the food service and the transfer of convicts.The first example of this model was carried out in the United States of America, andthen the penal institutions were started to be managed by the private sector in manycountries especially in Australia and the United Kingdom. The practice method of thismodel varies across the countries.
