Özet
5549 sayılı Suç Gelirlerinin Aklanmasının Önlenmesi Hakkında Kanun’daöngörülmüş olan şüpheli işlem bildirimi yükümlülüğü, hukukumuzda yükümlü olarakkabul edilenlerin, nezdinde veya aracılığıyla “yapılan veya yapılmaya teşebbüsedilen işlemlere konu malvarlığının yasa dışı yollardan elde edildiğine veya yasa dışı amaçlarla kullanıldığına dair herhangi bir bilgi, şüphe veya şüpheyi gerektirecekbir hususun bulunması halinde”, bu işlemleri MASAK’a bildirmelerini gerektirir.Bu bağlamda, “bilgi”, “şüphe” ve “şüpheyi gerektirecek husus” ifadelerinden neanlaşılması gerektiğinin açıklığa kavuşturulması önemlidir. Zira, özellikle “bilgi”ifadesinin anlamı, yükümlünün şüpheli işlem bildiriminden farklı bir bildirimyükümlülüğünü de gerektirebilir. Nitekim, işleme konu malvarlığı suçtan eldeedilmişse ya da bu malvarlığının yasa dışı amaçlarla kullanılması aynı zamanda suçteşkil ediyorsa, işlemin yapıldığı sırada ya da işlem tamamlandıktan sonra bu konuda“bilgi” sahibi olan yükümlünün, ayrıca suçu bildirme yükümlülüğü de söz konusuolabilir. Suçu bildirme yükümlülüğünün ihmali, 5237 sayılı Türk Ceza Kanunu’ndaöngörülen şartların gerçekleşmesi halinde, suç teşkil etmektedir. Bu makalede, Türkhukukunda şüpheli işlem bildirimi yükümlülüğüne dair açıklamalarda bulunulmuş ve bu yükümlülüğün ihmali halinde bildirimle yükümlü olan kişinin ceza hukukusorumluluğu incelenmiştir.
Abstract
The obligation of suspicious transaction reporting provided for in the Law onthe Prevention of Laundering of the Proceeds of Crime (Law No. 5549) requires those who are considered as obliged parties to report the transactions to MASAK, if “thereis any information, suspicion or reasonable grounds to suspect that the asset, whichis subject to the transactions carried out or attempted to be carried out within orthrough the obliged parties, has been acquired through illegal ways or used for illegalpurposes”. In this context, it is important to clarify what is to be understood from theexpressions of “knowledge”, “suspicion” and “reasonable grounds for suspicion”.Because, especially, the meaning of the term “knowledge” may also require a diff erentreporting obligation than the obligation of suspicious transaction reporting for theobliged party. Indeed, if the asset subject to the transaction has been obtained from acrime or the use of the asset for illegal purposes also constitutes a crime, the obligedparty who has “knowledge” about this, at the time the transaction is carried out orafter the transaction is completed, may also have an obligation to report the crime.The negligence of the obligation to report the crime constitutes crime, if the conditionsprescribed in the Turkish Criminal Code (Law No. 5237) are fulfilled. In this article,explanations concerning the obligation of suspicious transaction reporting in Turkishlaw are given and the criminal law responsibility of the person who is obliged toreport in case of negligence of this obligation is examined.
