Özet

Müteselsil borçluluk, niteliği itibariyle bölünebilen bir edimin birden fazla borçlusunun bulunmasıdır. Bu borç ilişkisinde borçlulardan her biri, alacaklıya karşı edimin tamamını ifa etmekle yükümlüdür. Müteselsil borçlulukta borcun doğumu kadar sona ermesi de önem taşımaktadır. Bu nedenle çalışmada, müteselsil borçluluğu sona erdiren nedenler incelenmiştir. Müteselsil borçluluğu sona erdiren nedenler BK. m. 145'de düzenlenmiştir Bunlar ifa ve takas gibi alacaklı tatmin edilmek suretiyle; ibra, kusursuz ifa imkânsızlığı, yenileme, alacaklı ve borçlu sıfatlarının birleşmesi, zamanaşımı, sulh ve konkordato gibi alacaklı tatmin edilmeksizin müteselsil borçluluğu sona erdiren nedenlerdir. Ayrıca çalışmada sona erme nedenlerine ilişkin olarak Borçlar Kanunu Tasansı'ndaki ilgili hükümler de incelenmiştir

Abstract

Joint indebtedness means that an obligation which is divisible in nature has multiple debtors. Each debtor is responsible for meeting all the claims of the creditor. As regards as the joint indebtedness, expiration of debt is not less important than its transpiration. Therefore, reasons for expiration of joint debt is analyzed in this study These reasons are set in Art. 145 of Turkish Code of Obligations. These reasons are classified as reasons satisfying (fulfillment and barter) or not satisfying the creditors (acquittal, objective impossibility, unification of the position of debtor and creditor, statute of limitations, amicable settlement and composition with creditors) in the article. Related provisions of the Draft Code of Obligations are also considered in this study.
