Özet
Eşlerden birinin evlilik birliğinin getirdiği yükümlülüklerden biri olan "sadakatyükümlülüğü"nü ihlâl etmesi hâlinde, diğer eşin, eşiyle birliktelik kurmuş olanüçüncü kişiye karşı tazminat dâvası açma hakkına sahip olup olmadığı ve buçerçevede, gerek yükümlülüğünü ihlâl eden eşin gerek üçüncü kişinin, sadakatyükümlülüğünün ihlâli nedeniyle zarar gören eşe karşı sorumlulukları özellikleYargıtay Kararları çerçevesinde yeknesak olmaktan uzaktır. Yargıtay, vermişolduğu bir Hukuk Genel Kurulu Kararı'nda (22.3.2017 t., 2017/4-1334 E. ve2017/545 K.), sadakat yükümlülüğünün ihlâlinde, evli kişiyle cinsel birliktelikyaşayan üçüncü kişinin, yükümlülüğün ihlâlinden zarar gören eşe tazminatödemesi gerektiğine çeşitli gerekçelerle karar vermiştir.Bu çerçevede çalışmada, ilgili Yargıtay Kararında yer alan hukuki dayanaklarınirdelenmesiyle, sadakat yükümlülüğünün ihlâlinde, yükümlülüğü ihlâl edeneş ile üçüncü kişinin hukuki açıdan sorumluluk durumları aydınlatılmayaçalışılacaktır.
Abstract
In case one of the spouses violates the "duty of loyalty" that is one of the dutiesto be caused by the union of marriage, if the other spouse has the right to suethe third person having affair with the spouse, and the liabilities of either thespouse violating the duty or the third person on account of the violation of theduty of loyalty have been far from uniformity in the verdicts of the SupremeCourt. In a verdict of the Supreme Court Assembly of Civil Chambers (dated22.3.2017, 2017/4-1334 B. and 2017/545 V.), it was finalised that third personwho had sexual intercourse with a married person requires to pay compensationto the spouse who is damaged due to the violation of the duty of loyaltyon several grounds.In this paper where there is such a framework, the legal grounds in relatedverdicts of the Supreme Court will be examined to be able to clarify the legalobligations of the spouse violating the duty of loyalty and third person in caseof the violation of the duty of loyalty.
