ETKİLİ BAŞVURU HAKKI ÖZELİNDE ANAYASA MAHKEMESİNİN BİREYSEL BAŞVURU USULÜYLE GERÇEKLEŞTİRMİŞ OLDUĞU DÖNÜŞÜM

Özet
Bireysel başvuru usulünün, Anayasa ve İnsan Hakları Avrupa Sözleşmesi’nin (İHAS) ortak koruma alanını kapsamasından dolayı Anayasa Mahkemesi, İnsan Hakları Avrupa Mahkemesi (İHAM) içtihadını daha yakından takip etmeye başlamıştır. Doğal olarak Mahkemenin temel hak ve özgürlüklerle ilgili bakış açısı ve yaklaşımı da dönüşmüştür. Çalışmada bu dönüşüm etkili başvuru hakkı özelinde ele alınmıştır. Anayasa’nın adil yargılanma hakkını İHAS’ın aksine konu bakımından sınırlandırmamış olması, etkili başvuru hakkı kavramının görece az kullanılmasına yol açmıştır. Bu durum Anayasa’nın 40. maddesinin neredeyse sessiz kalmasına yol açmıştır. Ne var ki bireysel başvuru usulüyle birlikte etkili başvuru hakkı ve adil yargılanma hakkı arasındaki ayrım daha da belirgin bir hâle gelmiştir. Anayasa Mahkemesi, İnsan Hakları Avrupa Mahkemesi (İHAM) içtihadından daha sık yararlanmaya ve temel hak ve özgürlükleri adeta İHAM ile diyalog hâlinde yorumlamaya başlamıştır. Böylelikle Anayasa Mahkemesi, özgün yapısı ve amacıyla, temel hak ve özgürlükler açısından önemli bir işlevi olan etkili başvuru hakkıyla ilgili yeni bir yaklaşım geliştirmiştir. Bu yaklaşım yalnızca bireysel başvuru kararlarıyla sınırlı kalmamış, norm denetimi kararlarına da yansımıştır. Çalışma, bireysel başvuru usulüyle geliştirilen yeni yaklaşım ve birikimin, Anayasa Mahkemesini nasıl dönüştürdüğüne ilişkin bir örnek sunmayı amaçlamaktadır. Abstract
Since the jurisdiction of the Turkish Constitutional Court ratione materia comprises the rights and freedoms of both the Constitution of the Republic of Turkey and the European Convention on Human Rights in the scope of individual access, the Court has started to follow the jurisprudence of the European Court of Human Rights more closely. As a matter of course, this has transformed the Turkish Constitutional Court’s perspective on fundamental rights and freedoms. This study deals with that transformation in the framework of the right to an effective remedy, the concept of which had been used relatively less due to the fact that there is no subject-matter limitation in terms of the right to a fair trial in the Turkish Constitution, unlike in the ECHR. That situation had resulted in Article 40 of the Constitution remaining practically silent, but then with individual access, the difference between right to an effective remedy and the right to a fair trial became clearer. The Constitutional Court has since started to refer to the jurisprudence of the ECtHR more often and to interpret the rights and freedoms in a dialogue with the ECtHR. In this way, the Constitutional Court has developed a new approach to the right to an effective remedy, which has an important role in terms of fundamental rights and freedoms with its unique structure and purpose. This approach was not limited only to individual access, but also reflected in the Constitutional Court’s judgments on constitutional review of norms. he study aims to provide an example of how the new approach and judicial background developed through individual access transformed the Constitutional Court.
