Özet

Bu makalede, Anayasa’nın 17. maddesi ile Avrupa İnsan HaklarıSözleşmesi’nin 3. maddesinde düzenlenen kötü muamele yasağı, dahagenel bir çerçevede de Anayasa Mahkemesi ve Avrupa İnsan HaklarıMahkemesi içtihatlarının ilk derece mahkemeleri tarafından uygulanmasıkonusu işlenmektedir.Kötü muamele yasağı başlığı altında, uygulama kıstasları arasındasayılabilecek olan “savunulabilir iddia”, “ispat külfeti” ve “asgari seviye”konuları açıklanmakta, ardından mağdur sıfatına ilişkin bir incelemeylegiriş yapılmaktadır.İkinci bölümde, devletin yükümlülükleri hakkında kısa bir bilgidensonra, “zor kullanma”, “tutulma koşulları, “tutuklu ve mahkûmlarınsağlık durumları” ile “sınır dışı ve iade hâlinde, geri gönderilen ülkedekötü muameleye maruz kalma riski” ve nihayet, “devletin usule ilişkinyükümlülükleri” hakkında, her iki yüksek mahkemenin içtihatlarınaatıfla bilgi verilmektedir.Son bölüm, Mahkemenin reform süreci ile ilgili deklarasyonların anakonusu olan “Sözleşme’nin iç hukukta uygulanması” hususuna ayrılmış,yargı sistemimizde son dönemde gerçekleştirilen iyileştirmelerinbirkaçına yer verilmiştir. Bunun yanı sıra kişilerin haklarına dahaerken kavuşmalarını, ayrıca Anayasa Mahkemesinin iş yükünün deazaltılmasını sağlamak üzere ilk derece mahkemelerinin içtihadı doğrudanuygulamasının önemine işaret edilmiştir.AİHM kaynaklarında (HUDOC) daha derin araştırma yapmak isteyenokuyucunun içtihat taramasını kolaylaştırmak maksadıyla bazı terimlerinİngilizce ve Fransızca karşılıkları dipnotlarda verilmektedir.

Abstract

This article aims first to provide information on the case-law of the Turkish Constitutional Court (“TCC”) and the European Court of Human Rights (“ECtHR”) regarding the prohibition of ill-treatment, governed by Article 17 of the Constitution of the Republic of Turkey and Article 3 of the European Convention on Human Rights. On a more general perspective, particular attention is brought to the implementation of the case-law of both high Courts, by the courts of first instance. Under the heading “Prohibition of ill-treatment”, key terminology such as “arguable claim”, “the burden of proof”, “minimum level of severity” and “victim status” are explained. In the second section, after a brief presentation of the States’ obligations, some of the main topics within the framework of the prohibition of illtreatment, such as “the use of force”, “conditions of detention”, “health issues related to detainees”, and the “risk of ill-treatment in case of extradition or expulsion” are explained with references to the case-law of TCC and ECtHR. The last section is devoted to “the implementation of the Convention in domestic law”, which is the common subject of the high-level conferences held during the reform process of the ECtHR, and some of the recent improvements in the Turkish judicial system. Emphasis is given on the importance of the application of the case-law by the courts of first instance in order, not only to enable individuals to have their rights recognised at an earlier stage, but also to reduce the workload of the TCC. The English and French equivalents of some keywords are given in the footnotes in order to provide a starting point to the reader who wishes to do extensive research in ECtHR database (HUDOC).
