Özet
Bu makalede Hans Kelsen’in “normatif alternatifler kuramı” eleştirel birgözle ele alınmıştır. Normatif alternatifler kuramına göre normun normlarhiyerarşinde üstte yer alan norma uygun olması gerekirse de bunun böyleolacağının bir garantisi de yoktur. Altta yer alan normun yaratılışını veiçeriğini belirleyen üstte yer alan norma uygun olmaması, özellikle altnormun, üstte yer alan norm tarafından öngörülen içerikten başka biriçeriğe sahip olması olasılığı dışlanamaz. Kelsen’e göre anayasaya aykırıyasayı anayasa mahkemesi anayasaya aykırılığı nedeniyle iptal edene kadaranayasaya aykırı yasa geçerliliğini koruyacaktır. Benzer biçimde özgünyorumlama yoluyla uygulanacak normun çerçevesinin tamamen dışındabir norm da oluşturulabilir. Bu yazıda Kelsen’in “normatif alternatifler”ve “çerçeve dışında” yargısal yorum başlıklı görüşlerinin “gerçekçi” veya“irrasyonalist” görüşler olarak düşünülebileceği vurgulanmıştır.
Abstract
In this article, Hans Kelsen’s “the theory of normative alternatives” has been handled critically. Although the norm should conform to the upper norm in the hierarchy of norms, according to the theory of normative alternatives, there is no guarantee that this will be so. The possibility that the underlying norm does not comply with the upper norm, which determines its creation and content, especially the possibility that the lower norm has other content than the content predicted by the upper norm cannot be excluded. According to Kelsen, the unconstitutional statute will remain valid until the constitutional court annuls the unconstitutional statute due to its unconstitutionality. Similarly, a norm can be created completely outside the framework of the norm to be applied through original interpretation. In this article, it was emphasized that Kelsen’s views titled “normative alternatives” and “judicial interpretation outside the frame” can be considered as “realistic” or “irrationalist” views.
