Özet
Bu çalışmada, eser sözleşmesinde işsahibinin ücret ödeme borcu üzerinde durulacaktır. Ücretin sınıflandırılması ile götürü bedel ve değere göre bedel kavramları açıklanacaktır. Yapılan eser sözleşmesinde ücretin belirlenmemiş olması durumunda, söz konusu ücretin neye göre belirleneceği incelenecektir. Ayrıca sözleşmenin değişen şartlara uyarlanması ve yüklenicinin sözleşmeden dönme ya da fesih hakkını hangi koşullarda kullanabileceği, uygulamada da önemli bir yere sahip olması dolayısıyla, ele alınacaktır.
Abstract
This study will focus on employer s duty of paying wages in contract of work. With the classification of wages, concept of value will be explained according to lump sum price and lump value. In case of undetermined wages in contract of work, what aforementioned wages would be based on will be examined. On the one hand, as it has a specific place in implementation, adaptation of the contract according to changing conditions, and under what circumstances a contractor can have the right of rescission and renege on a contract will be discussed.
