Özet
Bu çalışmada, Avrupa İnsan Hakları Mahkemesinin Altınay/Türkiye kararı incelenmiştir. Bu karar, ülkemiz yüksek öğretim sistemi gündemini uzun süre meşgul eden katsayı uygulaması sebebiyle ortaya çıkan bir mağduriyete iliş- kindir. Bu bağlamda, ilk olarak davaya konu olan olaylar açıklanmış, daha sonra Mahkemenin kararına yer verilmiş ve son olarak bu kararın hukuki mahiyeti saptanarak genel bir değerlendirmesi yapılmıştır.
Abstract
In this study, the European Court of Human RightsAltınay / Turkey case has been examined. This decision is related with a coefficient implementation victimization which is occupying long period of time for the agenda of our country s higher education system. In this context, firstly, the events according to the case are stated. Secondly, the decision of the Court has been given and finally, the evaluation of the decision is made by determining the legal nature of it.
