Özet
Kamu düzenini şiddetli ve yaygın bir şekilde sarsan, giderek devletin varlığını tehdit eden bunalımlar, tehlikeli durumlar, tabii afetler, salgın hastalıklar konusunda hem ülkenin geleceğini sağlamak, hem de vatandaşların temel hak ve hürriyetlerini korumak amacıyla önceden önlem almak demokratik devletler için önemli bir görevdir. Devlet, mevcut hukuk kuralları ile karşılama imkanının bulunmadığı bir tehdit veya tehlike karşısında olağanüstü hal rejimlerine başvurur ve bu rejimin bir parçası ve gereği olarak kamu özgürlüklerinin kullanımını durdurabilir. Demokratik devlet, insan haklarına saygıyı ve uluslararası sözleşmelerden doğan yükümlülükleri göz önünde bulundurarak anayasal çerçeve içerisinde bu tür olumsuzlukların giderilmesi konusunda olağanüstü yönetim usul ve metodlarına başvurmak için düzenleme yapmak zorundadır. Türkiye Cumhuriyeti Devleti de tarihsel süreç içerisinde geçirmiş olduğu olağanüstü dönemlerle birlikte birtakım etkin önlemler alma zorunluluğunu hissetmiş ve Anayasalarına olağanüstü hale ilişkin düzenlemeler koymuş, yürütme organına istisnai yetkiler tanımıştır.
Abstract
One of the must important duty of democratic states in order to protect fundamental rights and freedoms of their citizens and the future well-being of country is to take measures in advance in the crisis, widespread and violent acts such as natural disasters, epidemic diseases, state of emergency and war, which increasingly threat the existence of the state and disrupt the public order. States may face some emergency situations which may en danger or threathen the legal order and they may need to declare emergency power in order the cope with these situations. States may derogate their duties arising from human rights during the emergency regimes as a part of the legal order of it.Taking into account the respect for human rights and the obligations arising under international agreements which me state is a party to democratic states, aiming to improve these situations, must enact necessary regulations within the constitutional context for the application and implementation of the means and methods of state of emergency. The Turkish Republic of Turkey has felt that some necessary measures must be taken in the state of emergencies which have been observed in the past cases and therefore has provided some provisions in its constitutions governing these situations.
