Özet

23 Haziran 2016 tarihinde Birleşik Krallık Avrupa Birliğinden (AB) ayrılma için düzenlediği referandumda, halkın çoğunluğunun oyuyla ayrılmayı tercih etti. Halkın bu kararı doğrultusunda Birleşik Krallık, AB ile üyelikten ayrılma (Brexit) sürecini başlattı. Birleşik Krallığın AB'den ayrılmasının, AB ile olan ilişkileri açısından önemli sonuçları olacağı açıktır. Bu bağlamda Brexit süreci doğal olarak Kıbrıs'taki İngiliz Egemen Üs Bölgelerinin statüsünü de etkileyecektir. AB Andlaşmalarının bu bölgelerde uygulanabilirliği sorunu Kıbrıs'ın AB'ye entegrasyonuyla gündeme gelmiş ve Katılım Andlaşmasına eklenen 3. Protokol ile düzenlenmiştir. Bu Protokol uyarınca, bu bölgeler farklı bir statüye sahip olup AB hukuku bu bölgelere kısmen uygulanmaktadır. Ancak Brexit sonrası açısından, 3. Protokol'de düzenlenen konuların Avrupa Birliği ile Birleşik Krallık arasındaki Çekilme Anlaşmasında yeniden düzenlenmesi gerekmektedir.

Abstract

On June 23, 2016, the majority of the people in the UK voted to leave the European Union (EU) in the referendum on withdrawal of the United Kingdom (UK) from the European Union (EU). Towards this decision of the people, the UK invoked the formal procedure for withdrawing from the EU (Brexit). It is clear that the withdrawing of the United Kingdom from the EU will have important implications for its relevance to the EU. Brexit process will naturally also affect the status of British Sovereign Base Areas (SBA) in Cyprus. The question of the applicability of the EU treaties in these regions became an issue with the integration of Cyprus in the European Union and was primarily established by the Protocol n° 3 relative to the SBA, annexed to the 2003 Act of Accession. According to this Protocol, these regions have a different status and EU law is partially applied to these regions. In terms of post-Brexit, the Protocol n° 3 issues need to be rearranged in the Withdrawal Agreement between the European Union and the United Kingdom.
