Özet
Temerrüt faizi, para borcunun zamanında ödenmemesi üzerine kanun gereği işlemeye başlayan ve gecikme süresince işleyen alacağa bağlı bir karşılıktır. 6102 sayılı Türk Ticaret Kanunu*1 (TTK), ticari iş konusunu ayrıca düzenlemekte ve ticari işleri bazı farklı hükümlere tabi tutmaktadır. 3095 sayılı Kanuni Faiz ve Temerrüt Faizi’ne İlişkin Kanun*2 ticari işlerde temerrüt faizi konusunu farklı biçimde düzenlemektedir. Ticari işlerde temerrüt faizinden söz edilebilmesi için, öncelikle alacağın doğduğu işin, TTK kapsamında bir “ticari iş” niteliğinde olması gerekmektedir. Aksi halde “adi iş” sayılır ve adi işlerde temerrüt faizi konusu 6098 sayılı Türk Borçlar Kanunu’nda*3 (TBK) düzenlenmekle birlikte temerrüt faizi oranı yine 3095 sayılı Kanun’a tabi olmaktadır. Sigorta tazminatı, sigorta edilen menfaate bağlı olarak deprem, yangın, doğal afet, hırsızlık, savaş gibi risklerin gerçekleşmesi veya bir kaza neticesinde motorlu aracın işletilmesi gibi bir tehlike sorumluluğu ya da herhangi bir sebep sorumluluğu doğması hallerinde, sigorta şirketi tarafından ödenmesi gereken bir tazminattır. Tazminat alacaklısı ise bu risklerden birinin gerçekleşmesi dolayısıyla zarara uğrayan gerçek veya tüzel kişidir. Sigorta şirketinin tazminat ödemede temerrüde düşmesi halinde uygulanacak temerrüt faizi oranı işin ticari iş olup olmamasına göre değişmektedir.
Abstract
The default interest is a reward related to the payment of the money due on the due date, which commences the process as required by law and runs during the delay period. The Turkish Commercial Code (TCC), numbered 6102, also regulates commercial business and subject commercial transactions to some different provisions. The Legal and Default Interest Code, numbered 3095, regulates the default interest in commercial business in different ways. In order to be able to talk about the default interest in commercial business, the business that the first thing is taken must be a “commercial business” within the scope of TCC. Otherwise, it is considered “ordinary business”. Default interest in ordinary business is regulated in the Turkish Code of Obligations, numbered 6098, and the default interest is also subject to The Law No. 3095. Insurance indemnity is an indemnity that must be paid by the insurance company in the event of a risk liability such as the occurrence of risks such as earthquake, fire, natural disaster, theft or war, or the operation of a motor vehicle as a result of an accident. The indemnity creditor is a natural or legal person who has suffered a loss due to the occurrence of one of these risks. The rate of default interest to be applied if the insurance company defaults on compensation payments depends on whether the business is a commercial business or not.
