Özet
Osmanlı yargı sistemi içinde kurumsal bir yapı olarak Şuhûdü’l Hâl, uygulandığı çağlarda son derece önemli fonksiyonları yerine getirmiş olup aleni yargılanma hakkının bir hak olarak düzenlenmediği dönemlerde bu hakkın uygulamasını sağlamıştır. Ayrıca yargı üzerinde bir çeşit sosyolojik denetim mekanizması oluşturduğu da söylenebilir. Daha da önemli olan konu, özellikle Batı hukuk sistemlerinde neredeyse XIX. yüzyılın ürünü olan aleni yargılama, mahkemenin denetimi ve tarafsızlığı gibi kavramlar, eski hukukumuzda son derece başarılı bir biçimde uygulama alanı bulmuş ve bu yönüyle Osmanlı hukuk sistemini çağını aşan bir konuma getirmiştir. Kurumun işlevi aleni yargılama yapılmasının ötesine de geçmiştir. Zira kurul üyeleri yargılama makamına danışmanlık yapabildiği gibi sicile kaydedilen taşınmaz satışı gibi işlemlerde de işleme şahit olma görevini ifa etmişlerdir. Çağlar içerisinde oldukça önemli görev ifa eden kurum günümüzde uygulama alanı bulmamaktadır. Modern hukuk sistemimizde Şuhûdü’l Hâl’in ifa ettiği fonksiyonlar birden fazla kurum tarafından yazılı hukuk kuralları çerçevesinde yerine getirilmekte olduğundan bu kuruma ihtiyaç kalmamıştır.
Abstract
Şuhûdü’l Hâl, an institutional structure within the Ottoman judicial system, was of importance at the times it had been applied and it had served when the right to public trial was not in question yet. It can also be argued that Şuhûdü’l Hâl was a sort of sociological monitoring mechanism over the judiciary. More importantly, the concepts such as public trial, control and impartiality of court which were nearly products of the nineteenth century in Western legal systems found their places in our old law and made the Ottoman judicial system become ahead of its time. The function of the institution had gone beyond the right to public trial as well. The members of the institution were able to provide consultancy for the Judiciary while they were also performing the task of witnessing transactions in transactions such as immovable sales recorded in the register. The institution performing crucial tasks for ages does not have any application area today. Due to the fact that more than one institution have been serving at the present time on behalf of Şuhûdü’l Hâl, there is no need for such a regime no longer.
