Özet
Herkesin vücut bütünlüğü dokunulmazdır ve devlet koruması altındadır. Kişilerin vücut bütünlüğüne, ancak kanun hükmü gereği müdahale edilebilir. Tıbbi müdahalelerin, vücut bütünlüğünün ihlali sayılmaması için, hekimin müdahalenin niteliği, mahiyeti, önemi ve sonuçları hakkında hastayı aydınlatması ve hastanın da bu aydınlatma neticesinde, kendi kaderini tayin hakkı uyarınca ilgili tıbbi müdahaleye özgür iradesiyle rıza göstermesi gereklidir. Aksi halde hekimin, vücut bütünlüğünün ihlali sebebiyle, özel hukuk çerçevesinde hem sözleşmenin ihlali hem de haksız fiil sorumluluğu gündeme gelebilir. Plasebo tedavisinde ise, farmakolojik olarak herhangi bir etken madde içermeyen ancak normal ilaç görünümünde olan preparatlar hastaya verilmekte ve hasta çoğu zaman aydınlatılmadan, bu aldatıcı ilaçlarla telkin edilerek tedavi edilmektedir. Benzer şekilde bu doğrultuda, sözde cerrahi ameliyatlar dahi gerçekleştirilmektedir. Hekim, tedavi özgürlüğü çerçevesinde, hastaya plasebo tedavisi uygulayabilmektedir. Bunda herhangi bir hukuka aykırılık bulunmamaktadır. Ancak hekimin aydınlatma yükümlülüğü, plasebo tedavisinin can alıcı sorunu olarak ortaya çıkmaktadır. Zira hekim tarafından, hastaya plasebo tedavisi hakkında doğru ve yeterli bir aydınlatma gerçekleştirildiğinde, plasebo tedavisinin potansiyel iyileştirme etkisi (plasebo etkisi) zayıflamaktadır. Dolayısıyla plasebo tedavisi, amacına ulaşamamakta ve potansiyel faydaların ortaya çıkması azalmakta veya tamamen önlenmektedir. Abstract
Everyone's bodily integrity is inviolable and under state protection. The bodily integrity of individuals can only be interfered with in accordance with the provisions of the law. For medical interventions not to be considered as a violation of bodily integrity, the physician must inform the patient about the nature, essence, importance and consequences of the intervention, and the patient must voluntarily consent to the relevant medical intervention in accordance with the right to self determination. Otherwise, it may lead to both the violation of the contract and the tortious liability within the framework of private law, due to the violation of bodily integrity in terms of the physician. In the placebo treatment, preparates that do not contain any pharmacologically active substance but have the appearance of normal medications are given to the patient and the patient is often treated with these deceptive medications without being enlightened. Similarly, even so-called surgical operations are performed in this direction. The physician can administer placebo treatment to the patient within the framework of the physician's freedom of treatment. There is no contradiction to law in this. However physician's obligation to inform emerges as the crucial problem of placebo therapy. Because, when the physician provides the patient with accurate and sufficient information about the placebo treatment, the potential curative effect of the placebo treatment (placebo effect) is weakened. Therefore, placebo therapy fails to achieve its goal and potential benefits are diminished or avoided altogether. As a result of this situation, medical benefit and legal necessities come face to face. As a result, in placebo treatment, the question of whether exceptions should be made to the physician's obligation to enlightenment in order for the placebo effect to occur on the patient and the success of the relevant treatment comes to the fore.
