Özet

Sağlık gibi ciddî bir başlık devletlerin yaşamlarında sadece uluslararası çerçevede değil aynı zamanda iç düzen çerçevesinde de hayatî rol oynamaktadır. Zira devletler vatandaşlarının yanı sıra aynı zamanda uluslararası toplumun da bir bütün olarak genel sağlığını koruma ödevine sahiptir. Bunu yaparken ise, uluslararası işbirliği kesinlikle zarurîdir. Bu işbirliği, ilgili alanda, yâni sağlık alanında Birleşmiş Milletlerin uzmanlık kuruluşu teşkil etmesinden ötürü, temel olarak, Dünya Sağlık Örgütü tarafından sağlanmaktadır. Bu basit nedenden dolayıdır ki, Dünya Sağlık Örgütü kanun koyucu yetkilerle donatılmıştır. Bu bağlamda, Dünya Sağlık Örgütünün, sırasıyla, uluslararası sözleşmeler veya anlaşmalar, tüzükler ve tavsiyeler şeklinde üç normatif yetkisi bulunmaktadır. Bunlardan ilk ikisi, ilke olarak, üye devletler için bağlayıcı güçtedir. Tavsiyeler şeklindeki sonuncusu ise, fark edileceği üzere, bu tür bir etkiye sahip değildir. Her halükârda, üye devletler, en azından ilkesel bağlamda, tüm bu kurallara uymak zorundadır. Böylelikle, bu çalışmanın ana amacı Dünya Sağlık Örgütünün normatif kurallarının iç düzene etkilerini kısaca araştırmaktan ibarettir.

Abstract

A serious topic like health plays a vital rôle not only internationally but also domestically in the life of States. Because, States have the duty to protect the general health of their citizens as well as the international society as a whole. In doing so, international cooperation is indeed a necessity. And that cooperation among States has mainly been provided by the World Health Organization since it is the specialized agency of the United Nations in the concerned field i.e. health. Due to this simple fact the World Health Organization is weaponised by lawmaking powers. In this respect, there are three normative powers of the World Health Organization, which are international conventions or agreements, regulations and recommendations, respectively. The former two have, in principle, the binding power for the member States. The latter, which is the recommendations, do not have, as it appears, that kind of effect. Nevertheless, member States have to obey all of these rules, at least in principle. Thus, the main purpose of this study is to briefly investigate the domestic effects of the normative rules of the World Health Organization.
