Özet
Devletlerin, ulusal yargı organlarının kararlarına geçerlilik tanıması, egemenlik yetkisinin bir gereğidir. Bu sebeple kural olarak yabancı mahkeme kararlarının başka ülkede geçerli olması, o kararların iç hukukta tanınması ile mümkün olabilmektedir. Özel hukuk kökenli kavramlar olan tanıma ve tenfizin, ceza yargılamasında doğrudan bir karşılığı bulunmayıp yabancı ceza mahkemelerinin kararları, ceza yargılarının uluslararası değeri konusundaki uluslararası sözleşmeler çerçevesinde tanınabilmektedir. Bu tanıma, infazın devri, hükümlünün nakli gibi adli işbirliğine dayalı muhtelif süreçlerin sonucunda gerçekleşmektedir. Yabancı mahkeme kararlarının, diğer bir ülkede doğurduğu hukuki sonuçlardan biri de, ceza mahkumiyetine bağlı ortaya çıkan hak yoksunluklarıdır. Türk hukukunda hak yoksunlukları, kasten işlediği suçtan dolayı mahkûm olmuş bir kimse hakkında uygulanan güvenlik tedbiri niteliğindeki yaptırımlardır. Türk mahkemelerinin yargı yetkisine giren durumlarda, Türk mahkemesince verilen mahkûmiyet hükmünün kanuni sonucu olarak 53 üncü maddede yer alan hak yoksunlukları uygulanır. Türk veya yabancı ülke vatandaşı hakkında, yurtdışında işlediği suç nedeniyle yabancı mahkemelerce mahkûmiyet hükmü verilmesi durumunda, Türkiye’de yeniden yargılama yapılması mümkün değilse, Türk Ceza Kanunu’nun 17 nci maddesi çerçevesinde kişinin hak yoksunluklarına tabi tutulabilmesi mümkün olabilmektedir. Bu madde uyarınca, yabancı mahkeme hükmünün Türk kanunlarına göre hak yoksunluğuna ilişkin sonuçlarının geçerli olabilmesi için, yabancı mahkemelerden verilen hükmün Türk hukuk düzenine aykırı düşmemesi, Türk kanunlarına göre hak yoksunluğu gerektirmesi ve bu hususta Cumhuriyet savcısının istemi üzerine Mahkemece karar verilmesi gerekmektedir. Bu çalışmada, Türk Ceza Kanunu’nun 17 nci maddesinin uygulanma şartları incelenmiştir.
Abstract
It is a requirement of sovereignty that states validate to the judgments of national judicial bodies. Therefore, as a rule, the validity of foreign judgments in another country is possible with the recognition of those judgments in domestic law. Recognition and enforcement, which are concepts of private law, do not have a direct counterpart in criminal proceedings, and the judgments of foreign criminal courts can be recognized within the framework of international conventions on the international value of criminal jurisdictions. This happens as a result of various processes based on judicial cooperation, such as recognition, transfer of execution, and transfer of the sentenced person. One of the legal consequences of foreign judgments in another country is the deprivation of rights arising from criminal convictions. In Turkish law, deprivation of rights are sanctions in the nature of a security measure applied to a person who has been convicted of an intentional crime. In cases within the jurisdiction of Turkish courts, the deprivation of rights in Article 53 shall apply as a legal consequence of the conviction given by the Turkish court. In the event that a foreign court sentenced a Turkish or foreign citizen for a crime he committed abroad, if a retrial is not possible in Turkey, it may be possible for the person to be subject to deprivation of rights within the framework of Article 17 of the Turkish Criminal Code. According to this article, in order for the results of the foreign judgment to be valid according to Turkish law, the judgment rendered by foreign courts must not contradict the Turkish legal order, must require deprivation of rights according to Turkish law, and a judgment about it must be made by the Court upon the request of the Public Prosecutor. In this study, the implementation conditions of Article 17 of the Turkish Criminal Code were examined.
