Özet
Mağdur hakları son otuz yılda önemli bir gelişme göstermiştir. Davaya katılma konusunda, suçtan doğrudan zarar görmeyen, sivil toplum kurumlarına katılma imkânı tanınması, Avrupa’da ortaya çıkan önemli gelişmeler arasındadır. Türkiye’de ise davaya katılma konusunda yapılan düzenleme, sivil topluma değil, Aile ve Sosyal Politikalar Bakanlığı’na bu imkânı tanımaktadır. Bakanlığın etkili dava takip edecek avukat sayısına sahip olmaması nedeniyle söz konusu düzenleme işlevsizdir. Buna ek olarak yetişkin ve kırılgan olmayan mağdur grupları için, Bakanlığa mağdurun rızası olmaksızın davaya katılma hakkına sahip olması tanınması, yerinde değildir. Son dönemde Yargıtay İçtihadı Birleştirme Genel Kurulu’nun 2019/7 sayılı içtihadı birleştirme kararı ve Anayasa Mahkemesi’nin somut norm denetiminde verdiği 2020/8 numaralı iptal talebini red kararları da, Aile ve Sosyal Politikalar Bakanlığı’nın davaya katılmasıyla ilgili çeşitli sorunlara bağlantılıdır. Türkiye’de, Avrupa’daki gelişmeler göz önüne alınarak çevreye karşı suçlar ve kamu sağlığına karşı suçlar başta olmak üzere, topluma karşı suçlarda sivil toplumun kamu davasına katılmasına imkân veren bir yasal düzenleme yapılmasın yerinde olabilir. Bu tür bir düzenleme yapılacaksa, kendisine bu imkân tanınacak olan kurum, Cumhuriyet savcılığına destek olabilecek ve davaya yön verebilecek kapasiteye sahip olmalıdır. Bu noktada akla gelen ilk kurum şüphesiz ki barolardır. Bu çalışmada Fransız ve İtalyan örnekleri ortaya konulmak suretiyle, kamu davasına katılmanın, suçtan doğrudan zarar görmeyen kurumlar lehine genişletilmesinin gerekliliği ve yerindeliği konusu tartışmaya açılmaktadır
Abstract
Victim rights have improved significantly over the past three decades. Providing the opportunity to intervene cases to the nongovernmental organizations which are not directly harmed by crime, is among the important developments in Europe in this regard. In Turkey, on the other hand, the regulation on intervention provides this opportunity to the Ministry of Family and Social Policies, not to the civil society. The regulation is dysfunctional as the Ministry does not have the number of lawyers to pursue effective litigation. In addition, for adult and non-vulnerable groups of victims, granting the Ministry the right to intervene without the victim’s consent is not appropriate Recently, the decision numbered 2019/7 of the Unification General Assembly of the Court of Cassation and the decision numbered 2020/8 of the Constitutional Court to reject the annulment request are also related to various problems related to the intervention of the Ministry of Family and Social Policies. In Turkey, considering the developments in Europe, it may be appropriate to make a legal regulation that allows civil society to intervene criminal case in crimes against society, especially crimes against the environment and crimes against public health. If such an arrangement is to be made, the institution that will be given this opportunity should have the capacity to support the public prosecutor and direct the case. At this point, the first institution that comes to mind is undoubtedly the bar associations. In this study, the necessity and appropriateness of the extension of intervention in criminal case in favor of the institutions that are not directly harmed by the crime are brought into discussion by putting forward the French and Italian examples
