Özet
Ceza hukukunda suçun işlenmesi bakımından icrai-ihmali hareket ayrımı sadece suçun niteliğine etki etmemekte, aynı zamanda suça iştirak bağlamında önem taşımaktadır. Suç birden fazla kişi tarafından gerçekleştirildiğinde, söz konusu kişilerin sorumluluk statülerinin ne şekilde dikkate alınacağı, gerçekleştirdikleri katkılar esas alınarak belirlenmektedir. Bu ayrım özellikle suça iştirak bakımından ikilik sisteminin benimsenmesi halinde ön plana çıkmaktadır. Suçun icrai hareketle işlenebilmesi gibi ihmali hareketle de işlenebilmesi suça yönelik katkıların icrai olabileceği gibi ihmali de olabileceği sonucunu ortaya çıkarmıştır. Bununla birlikte ihmali nitelikteki hareketle suça katkının her durumda cezalandırılabilir nitelik taşıyıp taşımadığı önem arz etmektedir. Konu özellikle garantör tarafından gerçekleştirilen katkılar ekseninde ön plana çıkmaktadır. İcrai hareketle gerçekleştirilen suça garantörün katkısının her zaman faillik kapsamında mı dikkate alınacağı yoksa sadece yardım etme olarak mı değerlendirileceği meselesi çalışmanın merkezini oluşturmaktadır.
Abstract
In criminal law, the difference between act and omission in terms of committing the offence does not only affect the qualification of the offence, but is also important in the context of participation in the offence. When the offence is committed by more than one person, how the responsibility status of the people in question will be taken into account is determined on the basis of their contributions. This difference comes to the fore especially when the duality system is adopted in terms of participation in offence. The fact that the offence can be committed by omission, as well as by act, has revealed the conclusion that the contributions to the offence can be either act or omission. However, it is important whether the contribution to the offence through act of omission is punishable in any case. The subject comes to the fore especially in the context of the contributions made by the guarantor. The central issue of the study is whether the guarantor’s contribution to the offence committed by an act will always be taken into account within the scope of perpetration or whether it will only be considered as helping.
