Özet

Deliller ceza muhakemesinde maddi gerçeğe ulaşmanın bir ön koşulu olarak önemli bir yere sahiptir. Delilsiz bir ceza muhakemesinden bahsedilemeyeceği gibi ceza muhakemesinde delilden daha önemli bir kavram da yer almamaktadır. Sanık ve mağdurun haklarından, delili toplayan muhakeme süjelerinin uyması gereken kurallara kadar delillerin sirayet etmediği bir ceza muhakemesi müessesesi de bulunmamaktadır. Öyle ki deliller muhakemenin her alanında ileri sürülebilmenin yanında muhakemenin gidişatını değiştirebilecek niteliğe sahip olmaları bakımından da muhakemenin olmazsa olmazı olarak karşımıza çıkmaktadır. Ceza muhakemesinin başlamasına sebep olan bir suçun işlendiğinin öğrenilmesi de bir delil sayesindedir. Delillerin toplanması kadar ne şekilde değerlendirileceği de hayati önemi haiz bir konudur. Delilleri değerlendirirken dikkat edilecek hususlar ile delillerin değerlendirilmesinde uyulması gereken kurallar yargılamanın adilliği noktasında önemli güvenceler içermelidir. Delil değerlendirme yasakları da tam bu noktada devreye girmekte delillerin serbestçe değerlendirilmesine bir takım istisnalar öngörmektedir. Zehirli ağacın meyvesi doktrini de yıllardan beri gerek doktrinde ve gerekse yargı kararlarında tartışılagelen, ceza muhakemesi sistemlerinde delillerin değerlendirilmesi bakımından önemli bir yere sahip ve delillerin değerlendirilebilmeleri açısından yol gösterici nitelikte bir öğretidir. Genelde hukuka aykırı deliller bakımından ifade edilen doktrin, delil değerlendirme yasakları bakımından irdelenmemekte ve hukuka aykırı elde edilmiş olan bir delil sayesinde elde edilen delilin yargılamada kullanılıp kullanılamayacağı sorusunun cevabını bulmaya çalışmaktadır. Ancak yargılamada sadece hukuka aykırı deliller değil hukuka uygun yollarla elde edilmiş olsalar dahi sonradan bazı olguların gerçekleşmesiyle değerlendirilme dışı bırakılan birtakım deliller de bulunmaktadır. Bu bağlamda bu tür değerlendirilmesi yasak olan ancak hukuka uygun olarak elde edilmiş deliller sayesinde elde edilen diğer deliller değerlendirilebilecek midir, yoksa zehirli ağacın meyvesi doktrininin de olduğu gibi değerlendirmenin yasaklanması bu deliller sayesinde elde edilen delilere de mi sirayet edecektir? Makalede öncelikle zehirli ağacın meyvesi doktrinine ilişkin genel açıklamalar ve Ülkemiz uygulaması incelendikten sonra bu doktrinin delil değerlendirme yasakları bakımından uygulanıp uygulanamayacağı hususu irdelenecektir. Diğer bir ifadeyle, değerlendirilmesi yasak olan bir delil sayesinde elde edilen delilin yargılamada kullanılıp kullanılamayacağı sorusunun cevabı bulunmaya çalışılacaktır.

Abstract

Evidence has an important role in criminal procedure as a precondition for reaching the factual truth. Just as it is not possible to address criminal procedure without evidence, there is no concept in the criminal procedure that is more important than evidence either. Likewise, there is no criminal procedure under which evidence has no impact upon a range of elements from the rights of the accused and the victim to the rules that must be followed by those who collect evidence. Evidence also emerges as an indispensable part of the criminal procedure in that it may be provided at any stage of the procedure and, given its nature, it may change the course of the procedure. It is also thanks to evidence that it is found out that a crime has been committed, which then leads to the initiation of criminal proceedings. The manner in which the evidence will be evaluated is as much important as their collection. The points to be taken into consideration and the rules to be followed in the evaluation of the evidence must provide essential guarantees as to the fairness of the procedure. It is at this very point that the prohibitions on evidence evaluation come into play and provide for certain exceptions to the free evaluation of evidence. The fruit of the poisonous tree is a doctrine which has been discussed both as a doctrine and in judicial decisions for years, has an important place in the evaluation of evidence in criminal procedure systems and is a guiding doctrine in terms of evaluation of evidence. The doctrine, which is generally expressed in terms of illegally obtained evidence, is not examined in terms of evidence evaluation prohibitions and tries to find the answer to the question of whether the evidence obtained through an illegally obtained evidence can be evaluated. However, in the criminal procedures, there are not only illegal evidences, but also some evidences, even if they are obtained through legal means, that are excluded due to the realization of some facts. In this context, is it possible to evaluate the evidence obtained thanks to the evidence that has been obtained in accordance with the law but is forbidden to be evaluated? or will the prohibition of evaluation, like the doctrine of the fruit of the poisonous tree, also affect the insane obtained through these evidences? In the article, first of all, after examining the general explanations about the doctrine of the fruit of the poisonous tree and the practice of our country, whether the fruit of the poisonous tree doctrine has scope of application as regards the rules on the evidence evaluation prohibition will be discussed. In other words, it will be tried to find the answer to the question of whether the evidence obtained by means of an evidence that is forbidden to be evaluated can be evaluated in the criminal proceedings.
