Özet

ABD'de kürtaj ile ilgili yasal düzenlemelerin temel dayanaðý, 1973 yýlýnda kabul edilen Roe-Wade Anayasa Mahkemesi karardr. Eyaletlerin bir kýsmýnda çoðu kürtajý yasaklayan çeþitli yasal düzenlemeler olmasýna karþýn, bunlar federal yasaya aykýrý olduðu için geçersiz sayýlmaktadýr. Diðer yandan, kürtaj karþýtý gruplarýn çabalarýyla, pek çok eyalette kürtajý zorlaþtýran çeþitli uygulamalarýn kabul edildiði de görülmektedir. Bunlar; kürtaj hizmetinin Medicaid kapsamýndan çýkartýlmasý, kürtaj iþlemi öncesi en az 24 saat arayla kliniðe iki farklý ziyaret yapýlmasý zorunluluðu, kalp sesi dinletme, 20 yaþ altýnda altý gebeliklerde ebeveynin bilgilendirilmesi, kürtajýn kadýn saðlýðý açýsýndan zararlarý konusunda bilgilendirme, fetal acý konusunun gündeme getirilmesi ve bu konularda kadýnýn imzasýnýn alýnmasý gibi çeþitli uygulamalardýr. Ancak kürtajý kýsýtlayan uygulamalarýn kürtaj sýklýðýný azaltan bir etkisi olsa da gebelikten korunma sýklýðýný arttýrmadýðý, istenmeyen gebelikleri azaltmadýðý görülmektedir. ABD'de gebeliklerin yaklaþýk yarýsý istenmeyen gebeliktir ve bunlarýn da yaklaþýk onda dördü kürtaj ile sonuçlandýrýlmaktadýr. Yoksul kadýnlarda istenmeyen gebelik sýklýðý üst gelir düzeyine göre beþ kat daha fazla olmasýna karþýn, kürtaj olma sýklýðýnýn az olmasý, kürtajýn önemli bir ekonomik maliyeti olmasý ile iliþkili gibi görünmektedir. Benzer nedenle, zenci ve hispanik kadýnlarda ve de ergenlerde kürtajýn yapýldýðý gebelik haftasý daha ileri zamana kaymaktadýr.

Abstract

1973 Roe v. Wade Decision of Supreme Court is the cornerstone for the laws on abortion in USA. Although numbers of states have some form of anti-abortion laws, they are considered inapplicable since they violate the federal law. On the other side, several implementations have been adopted by some states to make abortion difficult as a result of the efforts of anti-abortion groups. They include exclusion of the abortion service from the Medicaid coverage, requirement for two separate visits to abortion clinic at least 24 hours between them, listening the fetus heartbeat, parental consent for the women younger than 20 years, informing women on the hazards of the abortions on women's health and fetal pain, and requesting them to sign a form indicating that she understands and accepts these consequences. Although these types of efforts reduce number of abortion cases but they don't have any impact on the frequencies of contraceptive use or unintended pregnancies. In US, almost half of the pregnancies are unintended, and four of ten those pregnancies result in abortion. Although the rate of unintended pregnancies among poor women is 5 times higher than women of upper income group the lower rate of abortions among lower income group seems to be related to high cost of abortion. For the same reason, the gestational age during abortion is shifted to later weeks among black and Hispanic women, and adolescents.
