Özet

Kamu özel ortaklığı kavramı dünyada 1990'lı yıllarda ortaya çıkmıştır. Kamu özel ortaklığı (KÖO), idare ile özel sektör arasında uzun süreli bir sözleşme ilişkisine dayanan ve kamu hizmetlerinin görülmesine ve/ veya finansmanına idare ile özel sektörün birlikte katılmasını öngören, finansman, altyapı ve hizmet sağlama modellerinin tümü için kullanılan bir üst kavramdır. Türkiye'de bu kavram 3359 sayılı Sağlık Hizmetleri Temel Kanunu'na 2005 yılında eklenen bir madde (ek madde 7) ile gündeme gelmiştir. KÖO modelleri dünyanın birçok ülkesinde uygulanmaktadır. Bu kavram, küreselleşme ve liberal ekonomi politikalarının bir ürünüdür. Dünyadaki KÖO uygulamalarına bakıldığında, KÖO modelleri ile, kamu hizmeti alanının yeniden düzenlenerek, devletin kamu hizmetlerindeki rolünün daraltılmasının amaçlandığı görülür. KÖO'ların yaygınlaşmasıyla birlikte, devletin kamu hizmetleri alanındaki rolü, daha çok düzenleyici ve denetleyici bir role dönüşmektedir. Bu bağlamda, çeşitli ülkelerdeki KÖO uygulamalarının hukuki açıdan incelenmesi bir gereklilik arzetmektedir.

Abstract

The concept of public-private partnership (PPP) has emerged in the 1990s in the world. Public-private partnership, which is based on a long-term contractual relationship between the administration and the private sector and is provided for the participation of the admininstration and the private sector together to the conduction and/or financing of the public services, is an umbrella concept used for all the models of funding, infrastructure and service delivery models. In Turkey, this concept came up with the article (addition article 7) which is added to the Health Services Code (Code No.3359) in 2005. PPP models are applied in many countries of the world. This concept is a product of globalization and liberal economic policies. When the PPP practices in the world are examined, it can be seen that it is intended to narrow the state’s role in the public services by rearranging the field of public service through the PPP models. By the spread of the PPPs, the state’s role in the field of public services has turned into a regulatory and supervisory role. In this context, examination of the PPP practices in various countries from a legal point ofview is a necessity.
