Özet

Son dönem Türkiye siyasetine damgasını vuran olgulardan biri hiç şüphesiz ki çok sanıklı, çok iddianameli davalardır. Ergenekon, Balyoz ve KCK gibi yargılama süreci yıllara yayılan davaların yanında, irili ufaklı birçok suça dair yargılamanın merkezinde Terörle Mücadele Kanunu (TMK) yer alıyor. TMKnın kapsamının genişliği, yasa maddelerinin muğlaklığı, yasanın uygulanmasında adli kolluk ve savcılığın gösterdiği keyfiyet ve savunmanın haklarını elinden alan istisnai yargılama usulleri TMKyı anayasal devlet ile karşı karşıya getirmektedir. Ancak ikisi arasındaki asli sorun, siyasi özgürlüklerin kısıtlanmasıdır. Bu bağlamda makalenin konusu, Türkiyede anayasal devlet içerisinde TMK ve devlete karşı suçlar kategorisinin yarattığı siyasi özgürlük sorunudur. Konu, hem hukuk hem de siyaset bilimi kapsamında değerlendirilmeye müsaittir. Yine de makale, hukuki bir tartışma ve analiz vaat etmemektedir. Sorunsal, siyasi özgürlüklerin anayasal devlet içerisinde yasalar yolu ile nasıl kısıtlanabildiği ve bu kısıtlamanın hukuk sistemine etkisi olduğu için, yapılan tartışma daha ziyade siyasi bir incelemedir. Bu inceleme yapılırken, Karl Marxın 1842de Prusya hükümetinin basına sansür ve Ren hükümetinin odun hırsızlığı ile ilgili düzenlemeleri hakkındaki yazılarında, yasal özgürlükler üzerine geliştirdiği düşüncelerden yararlanılmaktadır. Amaç, 21. yüzyıl Türkiyesinde anayasal devleti Marxın erken dönem olarak adlandırılan hukuk anlayışı doğrultusunda yorumlamak; içinde yaşadığımız devletin niteliğini bu yorum merkezinde yeniden düşünmektir.

Abstract

One of the most remarkable developments that marked Turkish politics in recent years is undoubtedly court cases which involved a number of indictments and nu- merous defendants. Beside court cases like Ergenekon, Balyoz and KCK, in the prosecution processes of recent years, proceedings of many large and small crimes take place on the basis of the Anti-Terror Law (TMK). The breadth of its coverage, the ambiguity of its articles, its arbitrary enforcement both by the police force and the jurists, and exceptional proceeding rules, which restrict the rights of the defense council and the defendant, are some of the elements of TMK that go counter to a constitutional state. However, the principle problem is the restriction of political freedoms by TMK. In this context, the subject of this article is the problem that TMK and the category of crimes against state pose for political freedoms with- in the constitutional state. This is both a political and a legal problem and can well be dealt with in the scope of jurisprudence or political science. Howbeit, this arti- cle is not a legal analysis of the issue and does not promise a legal discussion. Rath- er, the problem is defined as the restriction of political freedoms by laws within a constitutional state and the effects of such a restriction on the legal system. Conse- quently, the article presents a political analysis of TMK. In this analysis, the article uses Karl Marx s thoughts on legal freedoms developed in 1842 in his writings con- cerning the Prussian Government s instruction on censorship and the Rhine Prov- ince Assembly s law on wood theft. The objective is to explicate the conditions of the constitutional state and the legal system in the 21st century Turkey in line with Marx s early writings and thoughts on law, and to reconsider the characteristics of the state we live in accordingly.
