Özet

Der Beitrag befasst sich mit den zentralen Regelungen des deutschen Gendiagnostikgesetzes. Das GenDG ist am 1.2.2010 in Kraft getreten. Es erstreckt sich auf verschiedene Bereiche im Umgang mit genetischen Daten und umfasst die genetische Untersuchung zu medizinischen Zwecken, zur Klärung der Abstammung sowie die genetische Untersuchung im Versicherungsbereich und im Arbeitsbereich. Das Gesetz ist in Deutschland sehr umstritten. Besprochen werden die Probleme in der Konzeption und der Anwendung des Gesetzes. Diese betroffen etwa die Kernfrage, was überhaupt eine genetische Untersuchung darstellt. Weiter werden die Konzepte einer sog. großen und kleinen genetischen Beratung vorgestellt, je nachdem, ob die genetische Untersuchung auch auf prädiktive Anwendung zielt. Die Aufklärung über Zufalls- oder Nebenbefunde sowie Fragen der Qualitätssicherung werden ebenfalls angesprochen.

Abstract

The article deals with the central provisions of the german genetic diagnosis law. The GenDG (genetic diagnosis law) was entered into force on 1st of February 2010. It extends to various areas, dealing with the genetic data and includes the genetic analysis for medical purposes, clearance of descent and the genetic analysis in the insurance sector and the working area. In Germany the genetic diagnostic law is extremely controversial. The problems concerning the conception and application of the law are discussed. These are related to the key issue, what the genetic analysis represents. In addition the concepts of a so-called big and a small genetic counselling are presented, depending on whether the genetic analysis is aimed on predictive application. The education about accidental and incidental findings and questions about the quality assurance are also addressed.
