Özet

1991’de hastaların tıbbi yaralanmalarda tazminat imkânlarını geliş- tirmek için, tıbbi yaralanmalara karşı sigortayı düzenleyen 06 Haziran 1991 tarihli 367 sayılı Hastaların Sigortası Hakkında Kanun (LIP olarak anıla- caktır) takdim edilmiştir. Bu ve LIP’ın daha bir çok amacı, bu Kanun 25 Haziran 2010’da 706 sayılı Kanun ile değiştirilen 21 Ocak 2009 tarihli 24 sayılı Sağlık Sisteminde Şikayet ve Tazminat Hakkında Kanun (LCCHS olarak anılacaktır) tarafından yenilendiğinde, LCCHS’ye dâhil edilmiştir. LCCHS’nin diğer bir amacı ise hem hastalar için tazminat hakkını ve şikâ- yet sisteminin daha şeffaf olmasını hem de şikâyet sistemine daha basit ve doğrudan ulaşılmasını sağlamaktır. Aşağıda odak noktası, yorumlanması ve uygulanması hem Hasta Si- gorta Sendikası (PI olarak anılacaktır) ve Hasta Başvuru Heyeti (PAB ola- rak anılacaktır) tarafından verilen idari kararlara hem de birçok Yüksek Mahkeme kararına konu olduğundan, LIP §2 f.1 b.1-4 ile aynı olan LCCHS m.20 f.1 b.1-4 olacaktır. M.20’nin yorumu, seçilen mahkeme ve idarenin kararları ile örneklendirilecektir.

Abstract

In 1991 the Danish Law on Insurance for Patients (hereafter LIP) no: 367 of June 6th, 1991, regulating an insurance against medical injuries, was introduced in order to improve patients’ possibility to be compensated for medical injuries. This aim, as well as most of LIP, was incorporated when the law was replaced by the Law on Complaint and Compensation within the Healthcare System (hereafter LCCHS) no: 24 of January 21st, 2009, amended by law no: 706 of June 25th, 2010. Another aim of LCCHS was to make the right to compensation and the system for complaints more transparent for the patients, as well as the access to the complaint system more simple and direct1. In the following the focus will be on LCCHS art. 20 subs. 1 nr: 1 to 4, which is identical to LIP §2, subs. 1 nr. 1-42, since the interpretation and implementation of these has been the subject of the majority of both administrative decisions from the Patient Insurance Union (hereafter PI) and the Patient’s Appeal Board (hereafter PAB), as well as the subject of several Supreme Court decisions. The interpretation of art. 20 is illustrated with selected court and administrative decisions.
