TIBBİ UYGULAMA HATALARINDA ORGANİZASYON KUSURUNUN YERİ

Özet

Tıbbi malpraktis ve buna bağlı zararlar sadece medikal uygulama hatalarından değil organizasyon ve etik nedenlerden de ileri gelmektedir. Bu nedenle organizasyon kusurlarının neler olduğu ve yargı organlarının bu konudaki kararlarını irdeleyerek sorumluluğun türleri ve muhataplarını ortaya koymaya çalıştık. Organizasyon kusurlarının önüne geçmenin en önemli yolu kuşkusuz bunların tespitinden geçer. Ayrıca sağlık personelinin hangi durumlarda organizasyon kusurunun yargı organları tarafından kabul gördüğünü öğrenmesi kendi sorumluluk bilinci açısından hayati önem taşımaktadır.

Abstract

Medical malpractice and damages related with it are not only the result of medical application errors but also the result of organizational and ethical reasons. Thus, we tried to reveal the respondents and the types of responsibilities by examining what organizational defects are and the decisions of the jurisdiction on this subject. Beyond all question, the most important way to prevent these organizational defects is to detect them. Additionally, it is an essential fact that to learn by healthcare personnel in what situations organizational defects are accepted by judgement within the perspective of sense of responsibility.
