Özet
Avrupa Birliği (AB)’nin en büyük kazanımlarından olan sermayenin, malların, hizmetin ve kişilerin serbest dolaşım hakkı, sağlık hizmeti alanlara ve sunanlara da serbest dolaşım hakkı sağlamaktadır. Sağlık hizmetlerinden yararlanmak amacıyla dünyada gerçekleştirilen sınır ötesi hasta hareketliliği, Avrupa Birliği’nde de küresel eğilimlere ve AB entegresyonun derinleşmesine paralel olarak artmıştır. Üye devletlerin sağlık sistemleri arasındaki farklılıklar, hastaların başka bir ülkeden sağlık hizmeti almasını çok zorlaştırmakta ya da aldığı hizmetin kalitesini düşürmektedir.AB, üye ülkelerin ulusal sağlık sistemlerindeki farklılıkları azaltıp, üye ülkelerin mevzuatlarını yeknesaklaştırmak için “sınır ötesi sağlık hizmetlerindehasta haklarının uygulanmasına dair 9 Mart 2011 tarihlive 2011/24/AB sayılı Avrupa Birliği Parlamentosu ve Avrupa Birliği Konseyi Direktifini” hazırlamıştır.Bu çalışmada, Avrupa Birliği içerisinde sınır ötesi hasta hareketliliğinde hasta haklarının yasal çerçevesi, getirileri ve uygulanabilirliği tartışılacaktır.
Abstract
Free movement of capital, goods, services and persons which is one of the most significant acquirements of the European Union (EU), also ensures the right to freedom of movement to healthcare receivers and providers. Cross-border patient mobility around the world with the purpose of receiving healthcare has raised in the European Union too, in parallel with global tendencies and deepening EU integration. The differences between the healthcare systems of the member states, makes patients’ access to healthcare services in other countries quite difficult or reduces the quality of the services they receive. EU has prepared the “Directive 2011/24/EU of the European Parliament and of the Council of 9 March 2011 on the application of patients’ rights in cross-border healthcare” with the aim of reducing differences between the member states’ national healthcare systems. In this study, legal framework of the rights of patients, its outcomes and applicability will be discussed within the context of cross-border patient mobility in the European Union.
