Özet

İlacın (özellikle zorunlu ilaçların) ihtiyaç sahiplerine ulaştırılması için pek çok aşamadan oluşan bir faaliyet gerçekleştirilmektedir. İlaç olabilecek bir molekülün bulunması, bunun insana uygulanabilir hale getirilmesi için klinik deneylerinin yapılması, üretilen ilacın etkili, gü-venli ve kaliteli olduğunun ispatlanması için gerekli verilerin ilacı üreten tarafından toplanıp ruhsat makamına sunularak ruhsat alınması, bu faali-yetin başlangıç aşamalarını oluşturmaktadır. İlaçların maliyetleri sosyal sigorta sistemleri tarafından karşılanmaktadır. Bu nedenle ilaçların fiyat-ları belirli bir usul dâhilinde devlet tarafından belirlenmektedir. Fiyat-landırma olarak ifade edilen bu aşamandan sonra geri ödeme denilen bir aşamaya geçilmektedir. Burada ilaç sosyal sigorta kurumlarınca piyasa-dan temin edilmektedir. Türkiye’de Sosyal Güvenlik Kurumu, ilaçları eczanelerden temin etmektedir. Bu ise maliyeti devlet tarafından karşıla-nacak ilaçları ihtiva eden bir liste hazırlanması sureti ile olmaktadır. Ku-rum ile tedarikçiler arasındaki anlaşma çerçevesinde oluşturulan listede yer alan ve tedarikçiler tarafından hastalara ulaştırılan ilaçların bedelleri ödenmektedir. Bu süreç içinde idare ya hizmet sunan ya da gerçekleştiri-len faaliyeti düzenleyen ve denetleyen olarak bir rol üstlenmektedir. İşte bu çalışmada idare tarafından gerçekleştirilen bu faaliyetlerin idare hu-kuku açısından mahiyeti belirlenmeye çalışılmış ve bu belirlemenin so-nuçları değerlendirilmiştir.

Abstract

An activity which consists of many stages is carried out particular-ly for the delivery of compulsory medicines to the needy. Finding a mol-ecule that can be a drug, making clinical trials to make it applicable for human beings, obtaining license by submitting to the licensing authority the data collected by drug manufacturer required for proving that the produced drug is effective, safe and high quality, constitute the starting stages of this activity. The costs of drugs are covered by social insurance systems. For this reason, the prices of drugs are determined by the state under a specific procedure. After this stage, which is called pricing, re-imbursement stage comes. The drug is supplied by the social insurance institutions. In Turkey, Social Security Institutionprocures drugs from pharmacies. This is accomplished through preparing a list of drugs that will be covered by the state. The prices of medicines, delivered to the patients by the suppliers according to the list formed within the frame-work of the agreement between the institution and the suppliers, are paid. In this process, the administration assumes a role as a service pro-vider or as a regulator of the services performed by the private sector. In this study, the legal nature of these activities performedby the admin-istration for the procurement of drugs and the results of this determina-tion were evaluated in terms of administrative law.
