ORTOPEDİ VE TRAVMATOLOJİ ASİSTAN HEKİMLERİNİN HUKUKİ SORUMLULUKLARI

Özet
Kendi uzmanlık alanlarında uzman hekim (uzman doktor) yetiştirmekle yetkilendirilmiş Devlet ve vakıf üniversiteleri ile Gülhane Askeri Tıp Akademisi (669 sayılı KHK ile, 31.07.2016 tarihinde Sağlık Bakanlığına devredildiler) tıp fakültelerine bağlı uygulama ve araştırma hastaneleri ile Sağlık Bakanlığına bağlı eğitim ve araştırma hastanelerinde uzman adayı asistan hekim (tıpta uzmanlık öğrencisi) (araştırma görevlisi) öğretim ve eğitimi yapılmaktadır. Ancak asistan hekimlerin uzmanlık eğitimi aldıkları tıpta uzmanlık bölümlerinde görev ve yetki tanımlamaları tam olarak yapılmamış, bu konulara genel anlamda değinilmiştir. Tıp fakültelerindeki 6 yıllık eğitimden sonra pratisyen hekim ya da tıp doktoru unvanı ile mezun olan hekimlerin kamu görevlisi olarak ilgili anabilim dalında ya da yan dalda uzmanlık eğitimi alırken tıpta uzmanlık öğrencisi şeklinde isimlendirmenin hatalı olduğu düşünülerek çalışmada genel olarak asistan hekim ifadesi kullanılmıştır. Asistan hekim tanımlaması ile de uzmanlık eğitimi alan bu kişiler yardımcı hekim gibi algılandığından, en uygun ifade "uzman adayı hekim" olmalıdır. Zira asistan hekimler tıpta uzmanlık adayıdır. Bu nedenlerle, alıntı yapılan yerlerdeki zorunlu kullanmalar dışında genelde asistan hekim tanımlaması kullanılmıştır. Ortopedi ve travmatoloji tıp bilimi için uzmanlık eğitimi alan asistan hekimlerin aldıkları öğretim, eğitim ve buna dayalı hizmet verirken karşılaştıkları hukuki sorumluluk ve sorunlar ele alındığında, olayları hukukçu gözüyle değerlendirirken eldeki malzemeyi, yani asistan hekimi daha iyi tanıyabilmek ve tanıtabilmek için, çalışmada tıpta uzmanlık eğitim sürecine ağırlık verilmiştir. Bu amaçla çalışmada; uzmanlık öğrenim ve eğitimine yön veren Tıpta Uzmanlık Kurulu, Tıpta Uzmanlık Kurulu Müfredat Oluşturma Sistemi, Tıpta ve Diş Hekimliğinde Uzmanlık Eğitimi Yönetmeliği ile asistan hekimlerin çalışmalarını düzenleyen Kanun, Yönetmelik ve Genelgeler ele alınmıştır. Sorumluluk üç alt başlık altında değerlendirilerek tartışma bölümünde, asistan hekimlerin eğitimleri, görev ve yetki tanımlamaları ile bunların bilinçsizce yapılabilmesine bağlı olarak doğabilecek hukuksal sorunların nasıl önüne geçilebileceği gözden geçirilmiştir.
Abstract
Training and education service is provided for residents who are candidates to be specialist (research assistants) by state and foundation universities and by research and training hospitals affiliated to Gülhane Military Medical Faculty (transferred to Ministry of Health by decree law 669 on 31.07.2016) and research and training hospitals which are connected to the Ministry of Health that are all licensed to raise specialists in their own specialty field. However, the description of the mandate of the residents during their residency period is not clarified. After six years of training the residents graduate with the title of physician (general practitioner) or medical doctor and during their training in the specialty or subspecialty department they are named as residents throughout this study as it is believed that it may be wrong to call them as students of specialty in medicine. Since the term assistant physician implies that the physicians are in the process of assisting, the most appropriate term should be ''specialist trainee physician''. For the residents are candidates of specialist, the term resident is used except where it is obligatory to use some other term as it is referred. In regard to the legal liability during the time the residents provide service based on the training and education they receive for the orthopedics and traumatology medical science, emphasis has been placed on the specialty training in medicine in order to be able to get to know "the resident'' while interpreting the incidents from a jurist view. To serve this purpose, Board of Specialty in Medicine Board of Specialty in Medicine Curriculum Establishment System and Specialty Training Regulations in Medical Sciences and Dentistry that guide specialty training and education collectively were evaluated and the legislation,regulation and the public mandates were taken into consideration. The legal liability was evaluated under three subheadings and training of the residents, mandates and how to avoid the legal consequences of insensible behavior were interpreted in the discussion part.
