Özet
Çalışmamızın temelini eczacıların ve eczanelerin hukuki durumu oluşturmaktadır. Eczacıların sağlık personeli ve tacir nitelikleri; eczanelerin kendine özgü ticari işletme niteliği ve eczanelerde verilen hizmetin kamu hizmeti boyutu ele alınacaktır. Eczacıların hukuki sorumluluğu ve eczanelerin faaliyetleri konuları da kısaca açıklanacaktır. Yakın bir tarihte 3359 sayılı Sağlık Hizmetleri Temel Kanunu’nda 7243 sayılı Kanun ile değişiklik yapılmıştır. Sağlıkta Şiddetin Önlemesi Yasası olarak anılan bu Kanun değişikliğinin kapsamına dahil olan eczacıların ve eczane çalışanlarının hukuki durumları meselesi güncelliğini koruyan bir konu olması sebebiyle çalışma konusu kapsamına dahil edilmiştir.
Abstract
The basis of our study is the legal status of pharmacists and pharmacies. Health personnel and trader qualifications of pharmacists; The unique commercial nature of pharmacies and the public service dimension of the service provided in pharmacies will be discussed. The legal responsibility of pharmacists and the activities will also be briefly explained. Recently, the Health Services Basic Law No. 3359 was amended by Law No. 7243. The legal status of pharmacists and pharmacy workers, which is included in the scope of this Law amendment, which is referred to as the Law on the Prevention of Violence in Health, has been included in the scope of the study since it is a topic that remains up-to-date. Our article’s subject; The relevant legislation provisions, judicial decisions, and opinions in the doctrine will be explained, and our essential findings on the subject will be summarized.
