Özet

Aydınlatılmış onam, kişilerin kendi bedenlerinde gerçekleştirile- cek her türlü tıbbi girişimle ilgili rızalarının alınma sürecidir. Bu süreç, hastanın yapılacak bir tıbbi işleme onay vermesi veya reddedmesi için gerekli olduğu kadar bilgilendirilmesini ve bu bilgiler doğrultusunda özgür bir şekilde karar vermesini kapsamaktadır. Bu süreçte bilgilendir- menin nasıl ve kime yapılacağı hususu hala çok tartışmalıdır ve günü- müzde doğru bir şekilde alınmayan aydınlatılmış onam nedeniyle hekim- lere sıklıkla dava açılmaktadır. Bu makalenin amacı, kadın hastalıkları ve doğum hekimine aydınlatılmış onamda uygun şekilde hasta bilgilen- dirilmenin nasıl yapılması gerektiği hususunda bilgi vermektir. Bu çer- çevede öncelikle aydınlatılmış onam kavramının yasal evrimi ve temel özellikleri incelenecektir. Sonrasında kadın hastalıkları ve doğum vaka- larında aydınlatılmış onam hakkının ihlali nedeniyle açılan davalar ve sonuçları irdelenecektir.

Abstract

Informed consent is the process of obtaining the consent of indivi- duals for any medical intervention that could be performed on their bo- dies. This process includes informing the patient as much as necessary in order for them to approve or reject a medical procedure and make a free decision in accordance with the information presented. In this pro- cess, the issue of how and to whom the information will be given is still very controversial and physicians are frequently sued due to informed consent that is not received in a proper manner. The aim of this article is to present information to gynaecologists and obstetricians on how to inform properly for informed consent. In this context, the legal evolution and basic features of the concept of informed consent will be examined first. Later, the lawsuits filed for violation of the right for informed con- sent in gynaecological disease and birth cases and their consequences will be scrutinised.
