Özet
Yayma hakkı eserin aslı veya çoğaltılmış nüshalarının satışa çıkarılması ve diğer yollarla dağıtılmasını da içerir. Bu hakkın kullanılması sonucunda eserin, aslı ya da örneğinin mülkiyeti devredilerek ilk satışı veya dağıtımı yapıldıktan sonra, bunların yeniden yayımının engellenememesi genellikle yayma hakkının tükenmesi olarak ifade edilir. Bu ilkenin internet üzerinden yayılan eser örnekleri için de aynen geçerli olup olmadığı tartışmalıdır. Baskın anlayış bu durumu umuma iletim çerçevesinde değerlendirmektedir. Tam da bu sorunu kararında ele alan AAD, tükenme ilkesinin internet üzerinden indirilen programlar açısından da geçerli olduğunu benimseyerek, azınlık görüşüne katılmıştır. Bilgisayar programı doğ- rudan İnternetten indirilerek edinilmiş olsa bile, program üzerinde sürekli ve tam (kesin) şekilde kullanım hakkı tanınmışsa tükenme ilkesi geçerli olacaktır. Ancak kararda tükenme ilkesinin uygulanabilmesi için iki sınırlama getirilmiştir: Bunlardan ilki, lisansı devredenin kendi programını yok etmesi ya da kullanılamaz hale getirmesi, diğeri ise toplu lisansın yine toplu olarak devri zorunluluğudur. Bilgisayar programları bağlamında tükenme ilkesinin internet üzerinden gerçekleşen yaymalarda da uygulanması yerinde bir yaklaşımdır. AAD'nın getirdiği sınırlamalardan ilki yerindedir. AAD'nın tükenme ilkesinin uygulanması açısından benimsediği diğer sınırlandırma ancak somut olaydaki programın özellikleri ile bağlantılı şekilde değerlendirilir ise yerindedir. Aksi halde gereksiz bir kısıtlama niteliğindedir. Karar internet üzerinden sürümü yapılan diğer dijital ürünlerde de tükenme ilkesinin uygulanıp uygulanmayacağı tartışmasını daha canlı hale getirmiş- tir. Ancak karar doğrudan bu hususu ele almayıp salt bilgisayar programları ile ilgilidir. Kararda belirtilen temel önermeler Türk hukuku açısından kanaatimce aynen benimsenebilir. Bu şekilde internetten eserin izinli ve sürekli tam kullanımına izin verir şekilde indirilmesine imkan veren durumlar, yayma hakkı; kullanıcının seçtikleri yer ve zamanda esere erişime imkan sağlayacak şekilde internette hazır tutulmasını ise
Abstract
Te distribution right includes not only the sale or distribution of the original or copies of works but also the distribution of works in diferent ways. As a result of the use of this right, the inability to prevent works from re-distribution afer the frst sale of the work or the distribution by alienating the original work or its copies is generally considered as the principle of exhaustion. However, it is debatable whether the exhaustion principle also precisely applies to copies of the work published on the Internet. Dominant opinion regards this issue within the transmission to public. Having dealt with this issue in its decision, the ECJ agrees with the minority opinion over the fact that the principle of exhaustion applies to the programs downloaded from the Internet. Although the computer programme has been obtained by being downloaded directly from the Internet, the principle of exhaustion will still be valid provided the right to use is continuously and certainly granted over the programme. In this decision, in order for the exhaustion principle to apply, two restrictions have been accepted: First is that the alienator destroys his own programme or make it unusable, the other one is that collective licencing has to be alienated collectively. Regarding the computer programmes, it seems appropriate that the principle of exhaustion applies to the distributions over the Internet. Te frst restriction the ECJ has accepted is in principle correct and consistent in itself. Te other restriction the ECJ has adopted for the application of the principle of exhaustion is appropriate only if interpreted in relation to the features of the programme in a present case. Or it would be unnecessary restriction. Te decision of the ECJ has already sparked a debate whether the principle of exhaustion could apply to the other digital products, versions of which are made over the Internet. However, the decision is about the computer programmes without regarding this issue directly. Te principles of the decision, in my opinion, may also be exactly accepted in Turkish law. In this way, the situations enabling the work to be continuously, fully and legally downloaded from the Internet can be considered within the right of distribution. Moreover, the situations as making a work available on the Internet in such a way to be accessed at the determined place and time by the users can be considered within the transmission to public.
