Özet

“Bankacılık Kanunu’nun 62. maddesinin HukukîNiteliği, Uygulama Alanı ve Mülkiyet ve Miras HakkıYönünden Anayasa’ya Aykırılığı Sorunu”5411 sayılı Bankacılık Kanunu’nun 62. maddesi,mevduatın zamanaşına uğraması ile ilgili bir hükümiçermektedir. Hüküm şöyledir: “Bankalar nezdlerindekimevduat, katılım fonu, emanet ve alacaklardan hak sa- hibinin en son talebi, işlemi, herhangi bir yazılı talimatıtarihinden başlayarak on yıl içinde aranmayanlar za- manaşımına tâbidir. Zamanaşımına uğrayan her türlümevduat, katılım fonu, emanet ve alacaklar banka ta- rafından hak sahibine ulaşılamaması hâlinde, yapılacakilânı müteakiben Fona gelir kaydedilir. Bu maddeninuygulanması ile ilgili usûl ve esaslar Kurulca belirlenir”.Görüldüğü gibi, aranmayan mevduat ve diğer değerler,belli bir ilan sürecinden sonra TMSF’ye intikal etmektedir.Anayasa’nın 35. maddesine göre, herkes mülkiyetve miras hakkına sahiptir ve bu haklar ancak kamu yararıamacı ile ve kanunla sınırlanabilir. Ayrıca mülkiyethakkının kullanımı toplum yararına aykırı olamaz. İştebu noktada, 10 yıllık bir süreçte aranmayan mevduat vediğer değerlerin, devletin mülkiyetine geçmesi ve mudininbu alacaklarını talep hakkından yoksun kalması,kanımızca Anayasa’nın bu hükmüne aykırıdır. Avrupaİnsan Hakları Mahkemesi, borçlar hukuku anlamındabir alacak hakkı niteliğindeki mevdautı, sözleşme ve Ek1 nolu Protokol çerçevesinde mülkiyet hakkı kapsamındadeğerlendirmektedir. Sorun on yıllık sürenin kısalığındanziyade, bu süreçten sonra bir ara dönem (30, 50veya 100 yıl gibi) öngörülmeden, bankalarda unutulanmevduat ve diğer değerlerin Devletin mülkiyetine geçmesidir.Kuşkusuz bankalarda unutulan mevduat için biryasal düzenleme yapılması zorunludur. Ancak bunundiğer bazı ülkelerde olduğu gibi, belli bir süreden sonra(muhtemelen mirasçısı da kalmayacak bir zaman sonra)Devlete intikal ettirilmesi ve orada dahi belli bir amaçiçin kullanılması önerilir. Oysa bu haliyle düzenleme,mülkiyet hakkına doğrudan müdahale niteliğindedir.Çözüm olarak ya yasama organının hükmü yeniden elealması, ya da yerel mahkemeler veya Yargıtay’ın, konuyuAnayasa Mahkemesi’ne intikal ettirmesi ve olası bir iptalkararından sonra da yasama organının, hükmü yenidendüzenlemesi gerekmektedir.

Abstract

Article 62 of Banking Law numbered 5411 includes a provision related to bank deposits subject to prescription. The provision is as follows: “The deposits, participation funds, bailed goods or receivables at banks that has not been claimed by their owners within ten years following the latest request, transaction and written directive of their owners, shall be subject to prescription. Any deposit, participation fund, bailed goods and receivable that have been subjected to prescription shall be registered income for the Fund, following the publication of the announcement, if the bank cannot contact the owners of such. The principles and procedures applicable to the enforcement of this article shall be determined by the Board”. As it is seen, unclaimed bank deposits and other assets pass to “The Savings Deposit Insurance Fund” after a certain announcement process. According to Article 35 of the Constitution, everybody has property right and inheritance right, and such rights can only be limited for the purpose of public interest and by law. Furthermore, use of property right cannot be contrary to public interest. At this point, in our opinion, it is contrary to the abovementioned provision of the Constitution, when bank deposits and other assets unclaimed in a period of 10 years pass to the State’s ownership and the depositor deprives of the right to claim such receivables. European Court of Human Rights considers that a bank deposit -in the nature of the right to claim receivable within the meaning of Law of Obligations- is in the scope of property right within the framework of the European Convention on Human Rights and Protocol 1. Here, the problem is not brevity of ten years, but it rather lacks an interim period (such as 30 years, 50 years or 100 years and etc.) after this process to be foreseen to pass unclaimed bank deposits and other assets to the State’s ownership. Beyond any doubt, a legislative regulation must be made for unclaimed bank deposits. It is recommended for the State to pass unclaimed bank deposits or to use them for a certain purpose after a definite period (conceivably after a time when there will no longer be an inheritor), as it is applied in some other countries. However, the regulation, as is, constitutes a direct intervention on property right. As a solution, either the State’s legislature should reconsider the provision, or local courts or Supreme Court of Appeals should forward the issue to the Constitutional Court and the State’s legislature should reregulate the provision following a probable decision of annulment.
