مدينة رواية لا مدينة فقه وعمل متوارث: دراسة في أثر أنس بن مالك رضي الله عنه الحديثي والفقهي في البصرة

تصف هذه الدراسة الحركة الحديثية والفقهية في مدينة البصرة في النصف الثاني من القرن الأول، وتتخصص في أثر الصحابي الجليل أنس بن مالك رضي الله عنه في البصرة، كونه أشهر الصحابة الذين عاشوا فيها في تلك الحقبة وأجلهم وأطولهم صحبة للنبي صلى الله عليه وسلم، محللة كثيرا من الروا�ت المتعلقة به ومركزة على العلاقات العلمية بينه وبين الصحابة الآخرين والتابعين فيها وفي غيرها من الأمصار. وتوضح الدراسة مظاهر قوة الحركة الحديثية وضعف الحركة الفقهية في تلك الحقبة في ّج به الفقهاء أم المحدثون، وتدرس علاقاته ابلتابعين البصرة، فتدرس أثر أنس في طلابه، وهل تخر ورحلاهتم إليه، وأخذ الفقهاء منهم من الأمصار الأخرى عنه، وشخصيته الفقهية من خلال مصنف ابن أبي شيبة وغير ذلك، لتخلص إلى أن الملكة الفقهية عنده لم تكن على الدرجة ذاهتا التي تظهر في شخصية ابن عباس وابن عمر رضي الله عنهما، وتخلص كذلك إلى أن البصرة لم تكن مدينة فقهية تعتني ابلعمل المتوارث المنقول من طبقة فقهاء الصحابة إلى فقهاء التابعين كحال مدينتي المدينة والكوفة، ولكنها كانت مدينة ت نشرها والعمل بما ُعنى برواية الأحاديث و فيها بفضل الصحابي الجليل المكثر من الرواية أنس بن مالك رضي الله عنه، إلا أن نشر تلك الأحاديث لم يصاحبه حركة فقهية تضاهي حركة ابن عباس في مكة في الحقبة ذاهتا، فتأخرت البصرة فقهيا في جيل الصحابة ونشطت حديثيا، فحق أن ي اية لا مدينة ُطلق عليها إ�ا مدينة رو ف فقه وعمل متوارث.
Abstract
This paper describes the hadith and jurisprudence movements in the city of Basra in the second half of the first Hijri century and focuses on the effect of the great companion Anas ibn Malik in Basra. Anas was one of the most prominent companions during this period and was notable for his lengthy relationship with the Prophet (Allah bless him and give him peace). This study focuses on analyzing many narrations related to him and the scholarly relationship between him and other companions and the tabieen in Basra and other cities. Furthermore, this paper aims to show the manifestations of the strength of the hadith movement and the weakness of the jurisprudence movement and focuses on Anas' impact on his students and whether the students who graduated from his "school" were jurisprudents or hadith narrators. It also studies his relationship with the tabieen, their trips to him, and the study of the jurisprudents of the tabieen from other cities, and Anas' jurisprudential character (from Musannaf ibn abi Shaybah) etc… In conclusion, Anas' mastery of Fiqh was not like Ibn Abbas or Ibn Umar. In addition, Basra was not a jurisprudential city concerned with inherited actions transmitted from the great jurisprudents of the Sahaba to the great jurisprudents of the tabieen as occurred in Madina and Kufa. However, Kufa was a city concerned with hadith transmission due to the great companion Anas ibn Malik. Despite his profuse transmission of hadith, he didn't create a jurisprudential movement as did Ibn Abbas in Makka during the same period. Basra did not distinguish itself in jurisprudence during the period of the Sahaba but was very active in hadith so we can say it is a city of hadith transmission not city of jurisprudence and inherited actions.
