Özet
I. Meşrutiyet dönemiyle birlikte Osmanlı idarî terminolojisi içersine günümüzde sıkıyönetim karşılığı olarak kullanılan idâre-i örfiye kavramı girmiştir. Meşrutî idarenin hukukî zeminini oluşturan 1876 tarihli Kanûn-ı Esasî ile halka tanınan hak ve hürriyetler düzenlenirken olağanüstü hallerde bu hak ve hürriyetlerin ne şekilde tahdit edileceği ve muvakkaten askıya alınacağı hususu da belirtilmiştir. Meclis-i Vükelâ (Bakanlar Kurulu) ́nın almış olduğu örfî idare kararının padişah iradesi ile tasdiki gerekmekte olup, ilan edilen örfî idarenin en hızlı bir şekilde asayişi tekrar tesis edebilmesi ve suçluları vakit geçirmeden caydırıcı cezalarla yargılayabilmesi için Divân-ı Harbler kurulmuştur. Ancak, ilerleyen süreçte bu adın, nizamî askerî ceza mahkemeleri olan Dîvân-ı Harblerle karıştırılması sonucunda örfî idare nedeniyle kurulan mahkemelerin sonuna idâre-i örfiyenin örfîsi eklenerek yeni kurulan mahkemelere Divân-ı Harb-i Örfî adı verilmiştir. Bu çalışmada, Denizli Sancağı ́nda kurulan ve ilk dönemler Denizli Dîvân-ı Harb ́i adıyla geçerken daha sonra Denizli Dîvân-ı Harb-i Örfîsi adıyla yargılamalara devam eden mahkemede, ne tür suçların yargılamaya esas alındığı ve ne gibi cezalar verildiği incelenmiştir.
Abstract
ABSTRACT The term idare-i örfiyye (Martial Law), which was used as the equivalent of sıkıyönetim (Martial Law), entered Ottoman government terminology along with the first Constitutional Monarchy period. While rights and liberties were established through the Kanun-i Esasi (Basic Law) of 1876, which constituted the judicial base of legal government, the issue of how these rights and liberties would be restricted and supported temporarily by force majeure was stated. The decision for Martial Law (Örfi İdare), taken by the Council of Ministers, needed approval by Sultans decree, and Courts Martial (Divan-ı Harb) were founded so that the announced Martial Law could establish security in the fastest way possible and judge outlaws as soon as possible with deterrent penalties. However, after this name was confused with the legal Military Courts (Divan-ı Harb) in the periods that followed, by adding the Örfi of Martial Law (İdare-i Örfiyye) to the end of the name of the courts which were established by Martial Law, the newly founded courts were named Court Martial (Divan-ı Harbi Örfi). This study investigates the kind of crimes that were predicated on and the kind of penalties that were given by the court, which was founded in the Denizli Sanjak and was called the Denizli Court Martial (Denizli Divan-ı Harb) in the early periods and later continued to judge in the name of Denizli Court Martial (Denizli Divan-ı Harbi Örfisi).
