Özet

Yapılı çevrenin oluşumunda bağlayıcı ve yönlendirici olan imar mevzuatının,kent kimliğinin ve belleğinin korunmasına yönelik hazırlanması ve düzenlenmesigerekmektedir. Bunun sağlanabilmesi için de, imar mevzuatında yerel özelliklerinvurgulanması önemli olmaktadır. Türkiye’de mülga olan imar kanun veyönetmeliklerinde, geleneksel Türk kentinin biçimlenme öğeleri ile yerel özelliklerinyeterince dikkate alınmaması ve Avrupa kentlerinden esinlenilen bir biçimlenmesağlanmaya çalışılması sonucunda, kentlerin kimliklerinin korunmasında sorunlarlakarşılaşılmıştır. Bu sorunun çözümü olarak da, 03/07/2017 Tarih 30113 Sayılı PlanlıAlanlar İmar Yönetmeliği’nde Büyükşehir ve il belediyelerine, beldenin tarihi veyöresel şartlarını gözetmek kaydıyla, belirtilen değiştirilemeyen hükümler dışındakalan hususlarda Bakanlık onayı alınmak koşuluyla imar yönetmeliği hazırlamayetkisi verilmiştir. Bu bağlamda, çalışmada bu yönetmelik doğrultusunda, kendiyönetmeliklerini hazırlayan İstanbul, Bursa ve Gaziantep Büyükşehir Belediyelerininimar yönetmelikleri, yerellik bağlamında kıyaslanarak incelenmiştir. İncelemesonucunda, yerel özelliklerin korunması bağlamında mevcut yönetmeliğin de çözümüretemediği görülmüş ve çözüme yönelik öneriler sunulmuştur

Abstract

Zoning legislation, which is binding and guiding in the formation of the built environment, should be prepared and regulated for the protection of urban identity and memory. In order to achieve this, it is important to emphasize the local features in the zoning legislation. In the abolished zoning regulations in Turkey, to be taken into consideration adequately local characteristics with the shaping elements of traditional Turkish city and as a result of trying to ensure a remodeling inspired by the European cities, problems were encountered in the protection of urban identities. As a solution to this problem, in the Planned Areas Zoning Regulation no. 30113 dated 03/07/2017, metropolitan and other municipalities are authorized to prepare zoning regulations to be submitted to the approval of the Ministry with the consideration of the historical and local conditions of the town, except for the irrevocable provisions. In this context, the zoning regulations of İstanbul, Bursa and Gaziantep metropolitan municipalities, which prepare their own regulations in line with this regulation, have been examined and compared in the context of locality. As a result of the review, it was seen that the existing regulation could not produce a solution in the context of the protection of local features and suggestions were made for the solution.
